Risk transfer & risk sharing in outsourced choldren's service
Dear Devon Primary Care Trust (PCT),
The Guardian reports that Children's Services are out for tender to be outsourced/privatised:

Does the statutory responsibility for children being looked after remain with the public authorities (as "public bodies") as it is now?
How will risk be transferred to private providers?
How will risk be shared with private providers?
Please supply details of how risk will be transfered & shared.
For example, if the private provider is responsible for an abuse or failure leading to a CQC fine on to the public authorities (as "public bodies"), then will the private provider(s) be required to indemnify the public authorities & taxpayers from the cost of those fines?
How will current safeguarding protocols (including "whistle blowing") be enforced and monitored?
How will future changes to safeguarding protocols as a result of new guidance, serious case reviews and best practice changes be applied to contracts with existing providers e.g. how will the contracts flex during the contract term?
