I wish to request the following information under the terms of the
Freedom of Information Act 2000 'The Act'.

In order to assist you with this request, I am outlining my query
as specifically as possible. As you will understand, this may not
be a definitive list of relevant information.

You should also be aware that it is a requirement of the act to
respond within 20 working days and I am fully aware of my rights to
escalate this if you fail to follow this law.

You also should be aware that S16 of the Act provides a duty on yourselves to
assist requesters I.E. me.

1: Please provide the details (or web link) on when a RIDDOR submission must be made to the ORR .
2: Who must make this submission/Report?

RIDDOR 2013
3: Please provide details of any reports made since RIDDOR 2013 came into effect:
3.1 The details I am after are as follows:
3.1.1 Reporting Organisation, e.g. TOC Operating name, FOC Operating name, NeR Division, London Underground, etc.
3.1.2 Date of incident.
3.1.3 Date of Report/Submission.
3.1.4 Brief details of the incident requiring a RIDDOR report.
For the time periods:
3.2 Since RIDDOR 2013 came into effect until December 31st 2013.
3.3 January 1st 2014 until 31st July 2014

RIDDOR 1995
4: Please provide details of any reports made under RIDDOR 1995:
4.1 The details I am after are as follows:
4.1.1 Reporting Organisation, e.g. TOC Operating name, FOC Operating name, NeR Division, London Underground, etc.
4.1.2 Date of incident.
4.1.3 Date of Report/Submission.
4.1.4 Brief details of the incident requiring a RIDDOR report.
For the time periods:
4.2 January 1st 2013 until 30th September 2013.
4.3 The year of 2012.
4.4 The year of 2011.

If you are going to exempt any of the data or use an exemption then you need to consider S16 of the Act.

The data also needs to be provided in a easily readable format (.DOC, .PDF .XLS) in accordance with S11 of the Act.

Thank you for your e-mail of 31^st July requesting details of
notifications received under the Reporting of Injuries, Diseases and
Dangerous Occurrences Regulations 1995  (RIDDOR 1995), subsequently
amended by RIDDOR 2013.

 

I am handling your request under the terms of the Freedom of Information
Act 2000 (FoIA 2000).

 

In response to your request:

 

Details of when a RIDDOR notification should be made and by whom is exempt
under Section 21 of FoIA 2000 because this information is readily
accessible to you, as it is already in the public domain. Please see our
published guidance on RIDDOR available on our website at

Details of RIDDOR notifications received by the Office of Rail Regulation
(ORR) from the 1^st January 2011 to the 31^st July 2014 are contained in
the attached Excel spread sheet.

 

The data is based on:

 

·         Notifications for the national rail network received via the
Rail Safety Standards Board (RSSB) Safety Management Information System
(SMIS).

·         Notifications submitted by London Underground Limited through
the London Underground Safety and Environmental Analysis database (LUSEA).

·         Notifications from other railway and tramway operators including
metro systems, heritage and light rapid transit, using the ORR online
report form - [2]https://raildata.orr.gov.uk/riddor/.

 

Please note that data for most notifications received via the online
report form and LUSEA does not have a date of report or submission. The
systems were not initially set up to record a received date. We have
subsequently implemented changes to the RIDDOR online report form and
incorporated a Date stamp of when an incident was reported to ORR.

 

For RIDDOR 1995 data, a number of dangerous occurrences were subject to
monthly bulk reports:

 

·         DO57 Trams being struck by road vehicles.

·         DO63 Broken rails.

·         DO70(b) Wrong side signal failures.

·         DO70(e) Bridge bashes.

·         DO72 Signals Passed at Danger (SPADs).

 

Notifications for these bulk reports are not included. Section 12 of FoIA
2000 makes provision for public authorities to refuse requests for
information where the cost of dealing with them would exceed the
appropriate limit, which for central government is set at £600. This
represents the estimated cost of one person spending 3½  working days in
determining if whether the department holds the information, locating,
extracting and preparing the information for release. We have reached the
cost limit in providing the attached data, and to extract and compile the
reports subject to bulk reporting, would go over the cost limit. Please
also note that some dangerous occurrences were amended in RIDDOR 2013.
