Welsh Government’s Transgender Action Plan
Could I ask to see documents relating to your response to the draft Plan in 2015 and perhaps any further ones prior to the final issue mid 2016.

The WG report says you were consulted at the drafting stage of the Plan; perhaps you were consulted also on the draft Children’s Rights Impact Assessment. Could you please include a copy of this CRIA and your responses to the WG?

Dear Children's Commissioner for Wales,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Children's Commissioner for Wales's handling of my FOI request 'Response of the Commission to the WG consultation on the 2015-6 Transgender Action Plan'.

I do not accept that you really hold no paper or e-documents relating to the consultation by the WG in mid 2015 onwards on the Transgender Action Plan. You would have records on which staff members were involved and entries on worksheets, including perhaps meetings they attended. Their PCs would include e-mails fixing the meetings, exchanges on topics and even the consultation documents.

I appreciate that if you have records of staff being involved, you may need to redact personal details, but the redacted documents like meeting agendas and annotations would still be disclosable under FoI. So I ask for a deeper look into your records or explain why they were all destroyed.

-------------------------------------------RESPONSE TO INTERNAL REVIEW

Dear Anne Greagsby

Our Head of Communications and Performance, who’s also our Data Protection Officer, has asked me to review our response to your freedom of information request. I’m the Head of Practice for the Commissioner and am a member of her Management Team. I can confirm I had no part to play in your initial request, therefore can confirm that this has been an independent internal review.

I can confirm that the original response to your request was carried out in accordance with our Freedom of Information Policy and searches were made of all information systems that we retain at the Commissioner’s office . I can confirm that we do not hold any information on this consultation exercise.

There may be two reasons for this:

A) Records have been destroyed in line with our Document Retention Policy
B) We did not provide a written response to the Welsh Government consultation

Any email correspondence, meeting notes, information contained in staff notebooks will have been deleted in accordance with the schedules laid out in our Document Retention Policy.

If we had provided a written consultation response to Welsh Government we would still be able to access a copy of such a response from our electronic database. Searches of the database have not found such a response.

I appreciate that you may be frustrated with this response. If you are unhappy with the internal review you are entitled to complain to the Information Commissioner’s Office. https://ico.org.uk

I also wanted to reassure you that this is now an active policy area for us.
