Dear Lambeth Borough Council

In terms of the Freedom of Information Act of 2000, and subject to section 40(2) on personal data, could you please provide me with a complete and up-to-date list of all business (residential) property rates data for your local authority, and including the following fields:

- Billing Authority Property Reference Code (linking the property to the VOA database reference)
- Firm's Trading Name (i.e. property occupant)
- Full Property Address (Number, Street, Postal Code, Town)
- Occupied / Vacant
- Date of Occupation / Vacancy
- Actual annual rates charged (in Pounds)

If you are unable to provide an absolute “Occupation / Vacancy” status, please provide the Exemptions and / or Reliefs that a particular property may be receiving.

Our Response

 

Information on Lambeth Council’s business rates accounts can be found on
our website at:

This link also includes details of businesses that are in receipt of the
‘Exempt Empty Rate’.  Business owners who have notified Lambeth Council
that their premises are empty may receive the ‘Exempt Empty Rate’ for
three months.  After this time, most businesses must pay full business
rates.*

 

Lambeth Council does not maintain a record of businesses that continue to
be empty after the expiry of their three month ‘Exempt Empty Rate’ and as
such, the specific occupancy status data you require is not held.

 

Information on the Council’s business rates account liabilities is
published on the Council’s website quarterly, or as soon as practicable
thereafter.  Lambeth Council has therefore not provided the updated
version of data relating to your request as we believe that the following
exemption applies: Section 22 (Information intended for future
publication).  Section 22 of the Freedom of Information Act 2000 states at
the time a public authority receives a request for it, (1) Information is
exempt information if—

 

(a) the information is held by the public authority with a view to its
publication, by the authority or any other person, at some future date
(whether determined or not),

 

(b) the information was already held with a view to such publication at
the time when the request for information was made, and

 

(c) it is reasonable in all the circumstances that the information should
be withheld from disclosure until the date referred to in paragraph (a).

 

 

The application of this exemption is subject to a public interest test.   

 

Public interest test considerations

 

Factors in favour of disclosure

 

·         Lambeth Council acknowledges that disclosure would increase
transparency and improve the public’s understanding of this issue.

 

 

Factors in favour of maintaining the exemption

 

·         Allowing the proper running of the organisation in accordance
with established practices and following procedures set down to publish
information held.

·         The timetable properly requires internal or limited
consideration of the information prior to its public release.

 

The public interest in maintaining the exemption remains as there is a
clear timetable set for the additional information to be published and to
do so any sooner would divert Council resources in officer time and
circumvent the due process for ratification of the information.

 

In accordance with Section 17 FOIA this letter represents a Refusal
Notice.
