1. If a complainant requests reasonable adjustments under the Equality Act at the ‘outset/intake of a complaint what is the legal requirement of HCPC and how is it ‘fully’ considered under the Equality Act and it’s related codes of practice ?

2. a.How does HCPC record requests for reasonable adjustments ?
b. How is the decision making process reached and recorded and how does HCPC agree and communicate with complainant to escalate reasonable adjustments ?

3. How does HCPC record how reasonable adjustments may not be facilitated and does HCPC take legal advice and record that information if an adjustment is not reasonable ?

Thank you for your email dated 31 August 2019, in which you ask for
information in relation to reasonable adjustments under the Equality Act.

 

Your request has been handled under the Freedom of Information Act 2000
(FOIA).

 

We do routinely make reasonable adjustments for stakeholders who are
involved in our fitness to practise process. However, the precise form of
those adjustments will vary with the circumstances of the individual
seeking those adjustments. These adjustments are typically agreed between
the Case Manager and the concerned party.

 

In determining what reasonable adjustments might be made, a Case Manager
would consult the Health and Care Professions Council’s ‘Making reasonable
adjustments for HCPC customers and stakeholders’ guidance. This document
outlines to HCPC employees:

 

-       “what reasonable adjustments for customers and stakeholder are”;

-       “where reasonable adjustments are needed”;

-       “what to take into account when considering making reasonable
adjustments”; and

-       where to “access additional resources for more support”.
