Dear Dyfed Powys Police,

I am making the following request under the Freedom of Information Act 2000 in order to facilitate a piece of academic research. For clarity, references below to 'consensual child sexting' refer to any offence under s.1 of the Protection of Children Act 1978 or s.160 of the Criminal Justice Act 1988 committed (or alleged against) a child where the subject of the indecent image made, distributed or possessed consents to the offence. Can you please provide me with the following information:

1. How many individuals under the age of 18 have been dealt with by means of 'Outcome 21' (per the Home Office counting rules) for any offence relating to consensual child sexting in:

a. 2016
b. 2017
c. 2018

2. How many individuals under the age of 18 have been deal with by means of a simple or conditional caution for any offence relating to consensual child sexting in:

a. 2014
b. 2015
c. 2016
d. 2017
e. 2018

3. How many individuals under the age of 18 have been charged with any offence relating to consensual child sexting in:

a. 2014
b. 2015
c. 2016
d. 2017
e. 2018.

I write in connection with your request for information dated and received in the Freedom of Information Unit at Dyfed-Powys Police on 23/11/18 regarding consensual child sexting disposals. Your request for information has been handled under the Freedom of Information Act 2000 and has now been considered.

Section 1 of the Freedom of Information Act 2000 places two duties on public authorities. Unless exemptions apply, the first duty at Section 1(1) (a) is to confirm or deny whether the information specified in a request is held. The second duty at Section 1(1) (b) is to disclose information that has been confirmed as being held.

I can confirm that Dyfed-Powys Police does hold the information you have requested. However we are withholding the whole of the requested information since we consider that the Section 12 (1) exemption the Cost of Compliance exceeds the Appropriate Limit applies to it.

Where exemptions are relied upon Section 17 of the Freedom of Information Act 2000 requires Dyfed Powys Police, when refusing to provide such information (because the information is exempt) to provide you the applicant with a notice which: (a) states that fact, (b) specifies the exemption in question and (c) states (if that would not otherwise be apparent) why the exemption applies.

Please see the attached response document which indicates the time estimated by the Force it would take to complete the request as a whole and the exemption applied concerning the non-release of the information in its entirety.

In accordance therefore with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for the Whole of this request under Section 17(5) A public authority which, in relation to any request for information, is relying on a claim that section 12 or section 14 applies must, within the time for complying with section 1(1), give the applicant a notice stating that fact. You may wish to refine and resubmit your request so that it reduces the time shown above to fall within the 18 hours, should you require any further advice in relation to this matter please don’t hesitate to contact the Freedom of Information unit?

If you are unhappy with the way your request for information has been handled, you can request a review by writing to the Freedom of Information Unit address supplied on the attached appeal process document.

I am writing to request an internal review of Dyfed Powys Police's handling of my FOI request 'Request for information relating to consensual child sexting disposals'.

I am somewhat surprised to note that the information requested will take such a disproportionate amount of time and resource, as it has been routinely provided by all but one of the police forces who have responded to my request, as such information is routinely referred to by the NPCC (see, for example, https://news.npcc.police.uk/releases/pol...) and because recording and counting offences and outcomes is a legal requirement under the Home Office Counting Rules.

I have considered the case, including your explanation as to why you seek
a review and the materials to which you referred; I have queried with the
client department the types of information recorded; manner of recording/
retrieval and the time estimates provided for enquiry of the information
pertinent to your request. 

 

Whilst I understand this shall be disappointing to you, I confirm I uphold
the original response provided. 

 

Having discussed the matter personally with the Force Crime and Incident
Registrar, I am advised there is no sub classification in use which would
assist retrieval of the data you seek and therefore each account would
need to be considered to which the Registrar provides a broader [5-10
minutes] time estimate than that which was applied to your original
response.

 

I am therefore satisfied that the Freedom of Information Act 2000 has been
complied with in considering your request for information and that an
appropriate, valid and reasoned response has been provided to you.  Within
the response package, you were provided with an explanation of the
exemption applied.

 

It of course remains open you to consider whether to submit a new, refined
request.
