Request for information relating to consensual child sexting offences
Dear Dyfed Powys Police,
I am making the following request under the Freedom of Information Act 2000 in order to facilitate a piece of academic research. Can you please provide me with the following information:
1. How many individuals under the age of 18 have been dealt with by means of 'Outcome 21' (per the Home Office counting rules) for any offence relating to consensual child sexting in:
a. 2016
b. 2017
c. 2018
2. How many individuals under the age of 18 have been deal with by means of a simple or conditional caution for any offence relating to consensual child sexting in:
c. 2016
d. 2017
e. 2018
3. How many individuals under the age of 18 have been charged with any offence relating to consensual child sexting in:
c. 2016
d. 2017
e. 2018.
For clarity, references above to 'consensual child sexting' refer to any offence under s.1 of the Protection of Children Act 1978 or s.160 of the Criminal Justice Act 1988 committed (or alleged against) a child where the subject of the indecent image made, distributed or possessed consents to the offence and is also a child. At the material times, such offences were 'counted' under Home Office Counting Rules as offences 86/02 and 86/10.
Please kindly confirm whether the requested information is being provided in full or in part in your response, identifying which elements (if any) are not provided. For example, if you are unable to identify whether offences are 'consensual', please provide data relating to the requested offences/disposals and confirm that these include both consensual and non-consensual offences/disposals.

I am writing to request an internal review of Dyfed Powys Police's handling of my FOI request 'Request for information relating to consensual child sexting offences'.
A request for data relating to sexting disposals was sent by me to you on 22 March 2023. Confirmation that this was received by you was sent by your mailbox on the same date. It is now 22 June 2023 and no substantive response has to date been received.
The statutory timeframe for a response has now passed by some two months. Please kindly provide urgently a substantive explanation as to why no response has yet been received and the data originally requested by me on 22 March.

The case, including all correspondences has been considered; presently
there is nothing of substance to review as no decision has yet been
reached.
The FOI Department appreciate that their handling of your request is
unfortunately overdue. The Department regrets how owing to a backlog
they have not communicated with you in this regard to update you but
undertake to attend to your request as soon as possible.
Whilst regrettable and the FOI Department extend to you their apologies,

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities. Unless exemptions apply, the first duty at Section
1(1)(a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1)(b) is to disclose
information that has been confirmed as being held.
I can confirm that there is no information held/recorded by Dyfed-Powys
Police in relation to your request.
