Request for information - Environmental Information Regulations 2004

Dear Together Housing,

Following an FOI request made to Calderdale Council, I have been informed that you now manage the housing stock previously owned/managed by them. as follows:-
"This Authority no longer holds any housing stock - all housing stock was transferred to Pennine Housing 2000 in March 2001.
Pennine Housing became part of the Together Housing Group in 2012 and changed their name to Together Housing in April 2017."
The statement on your website claims, "We are one of the largest housing associations in the North of England, managing over 36,000 homes across Yorkshire and Lancashire"

I understand that this Housing Association is probably not strictly subject to the Freedom of Information Act. However The National Housing Federation Code of Governance states that associations should operate in an open and accountable manner by generally making information about their work available to their residents, local communities and other stakeholders.

Also the Information Commissioner has ruled that Housing Associations are subject to the Environmental Information Regulations.

Asbestos is an Environmental issue

SOME OF THE TYPES OF ASBESTOS MATERIALS THAT MAY BE FOUND IN HOMES ARE:
Insulating board
Lagging
Sprayed coating
Asbestos-cement
Other building materials and products – used in a variety of other building materials, such as decorative coatings (eg. textured paints and plasters/artex)
Heating appliances and domestic equipment

Therefore in relation to this, can you please provide me with the following information relating to your housing stock within West Yorkshire :-

1/ Can you please supply a list of all domestic/residential construction types (Standard, Non Standard/ Pre-fabricated) that are known to contain asbestos, which are owned by or managed by Together Housing Group, that were previously the responsibility of the above mentioned Calderdale Council.

2/ the locations within those properties (construction) types where asbestos is known or expected to be found. -see above list. (copies of owner/occupier data, or information sheets are acceptable)

3/ A list of all the postcodes of such properties.

I refer to my FOI request dated 13th August, and note I have not yet had a response.
In my request I noted that I "understand that. However The National Housing Federation Code of Governance states that associations should operate in an open and accountable manner by generally making information about their work available to their residents, local communities and other stakeholders.

Also the Information Commissioner has ruled that Housing Associations are subject to the Environmental Information Regulations.
Asbestos is an Environmental issue"

Please note that in dealing with my request, it should be considered it under
the Environmental Information Regulations 2004, as opposed to under the
Freedom of Information Act 2000. This is because the information I have
requested is information involving ‘activities’ and ‘administrative
measures’ which are likely to affect elements of the environment under Reg
2(1)(c).

I therefore look forward to a prompt reply to my original request, failure to do so WILL result in a formal complaint to the Information Commissioner

Thank you for your update, however, as I have already had a full and open response from Leeds City council in reply to my request to them for the same information about their properties, I cannot see how or why there should be a problem with data protection, and as the quote regarding EIR has come directly from the ICO, there should be no problem their either! therefore I look forward to a prompt reply!

Thanks for your reply, however I note that you have only given Postcode Districts, whereas my request was for actual postcodes!
"3/ A list of all the postcodes of such properties"
It is impossible to tell which streets are affected without this information - therefore can you please give more precise details as requested?
Please note that in response to a similar request to Leeds City council, have given full and frank disclosure including the relevant postcodes.
