Former Detective Constable Jon Wedger has provided information via a number of you tube videos taken at public events including the ITNJ Judicial Commission of Inquiry into Human Trafficking and Child Sex Abuse.

(1) One of the issues raised appears to relate to child prostitution and the death of a young girl.

The information provided suggests that a senior officer may have committed a criminal offence of misconduct in public office by suppressing an intelligence report and intimidating MrWedger.

The report submitted by Mr Wedger is believed to have highlighted that a known prostitute involved in recruiting children for prostitution was connected with high ranking senior officers, a Magistrate and someone in an executive position at the BBC.

(2) A further concern was raised concerning sex offenders avoiding registration by residing on canal boats. Mr Wedger states he was provide with 2 names via the prison service and was tasked to find more within a set period of time and apparently located 90 sex offenders.

Mr Wedger was informed that the investigation was apparently being shut down due to funding issues.

Please provide information as to the remit of the investigation, the outcome (report) and what action was taken subsequently to deal with the problem identified of sex offenders utilising canal boats to live on and move around to frustrate the registration process.

(3) This is a public interest matter for several reasons including that one of the senior officers complained of is now believed to have been promoted to a Chief Constable in charge of a different police force.

At the start of the youtube clip there is also mention of the involvement of the IPCC, please provide a copy of the outcome of any IPCC investigation concerning the matters raised above specifying whether any such investigation was conducted locally, supervised, managed or conducted by the IPCC themselves.

I write in connection with your request for information which was received
by the Metropolitan Police Service (MPS) on 02/10/2018.  I note you seek
access to the following information:

ITNJ Judicial Commission of inquiry into Human trafficking and Child Sex

Former Detective Constable Jon Wedger has provided information via a
number of you tube videos taken at public events including the ITNJ
Judicial Commission of Inquiry into Human Trafficking and Child Sex Abuse.

(1) One of the issues raised appears to relate to child prostitution and
the death of a young girl.

The information provided suggests that a senior officer may have committed
a criminal offence of misconduct in public office by suppressing an
intelligence report and intimidating MrWedger.  

The report submitted by Mr Wedger is believed to have highlighted that a
known prostitute involved in recruiting children for prostitution was
connected with high ranking senior officers, a Magistrate and someone in
an executive position at the BBC.

(2) A further concern was raised concerning sex offenders avoiding
registration by residing on canal boats. Mr Wedger states he was provide
with 2 names via the prison service and was tasked to find more within a
set period of time and apparently located 90 sex offenders.

Mr Wedger was informed that the investigation was apparently being shut
down due to funding issues.

Please provide information as to the remit of the investigation, the
outcome (report) and what action was taken subsequently to deal with the
problem identified of sex offenders utilising canal boats to live on and
move around to frustrate the registration process.

(3) This is a public interest matter for several reasons including that
one of the senior officers complained of is now believed to have been
promoted to a Chief Constable in charge of a different police force.

At the start of the youtube clip there is also mention of the involvement
of the IPCC, please provide a copy of the outcome of any IPCC
investigation concerning the matters raised above specifying whether any
such investigation was conducted locally, supervised, managed or conducted
by the IPCC themselves.

DECISION

This letter is to inform you that it will not be possible to respond to
your request within the cost threshold.  This response serves as a Refusal
Notice under Section 17 of the Freedom of Information Act 2000 (the Act).
 Please see the legal annex for further information on the exemptions
applied in respect of your request.

REASONS FOR DECISION

I would firstly like to take this opportunity to apologise for the delay
in responding to you and thank you for your patience.

Question 3 exceeds the cost threshold in determining what information is
held. As a reminder you have requested:  

“please provide a copy of the outcome of any IPCC investigation concerning
the matters raised above specifying whether any such investigation was
conducted locally, supervised, managed or conducted by the IPCC
themselves.”

As you are seeking access to any records related to actiontaken by the
MPS, to deal with the problem of sex offenders utilising canal boats to
frustrate the sexual offender registration process would exceed the cost
threshold. To put this into context two investigations were conducted
which dated back to 2015 which related to this area of interest. To answer
this question, I will firstly need to identity all of the papers connected
to the investigation into Jon Wedger’s allegations – which in this case
relates to the two investigations and anything supplied to us by the IPCC
over the 3 year period. These papers would then need to be scrutinised to
identify if any action was recommended and acted upon in respect of sex
offenders using canal boats.

To determine what action was recommended and acted upon would require
contact with those areas of the Met who could have taken forward a
recommendation from this investigation and/or are involved in managing sex
offenders to establish if they have taken forward a recommendation arising
from the investigation or more generally. As a minimum this would covers
areas such as the Marines Unit, the Sexual Offences Unit and what was once
known as the Clubs and Vice Unit. It is these extensive searches that
exceeds the cost threshold.

We therefore estimate that the cost of complying with this request would
exceed the appropriate limit. The appropriate limit has been specified in
regulations and for agencies outside central Government; this is set at
£450.00.   This represents the estimated cost of one person spending 18
hours [at a rate of £25 per hour] in determining whether the MPS holds the
information, and locating, retrieving and extracting the information.

I would like to provide you with advice as to how you may narrow your
request so that it does not exceed the appropriate limit.

I write in connection with your request for information which was received
by the Metropolitan Police Service (MPS) on 02/02/2019.  I note you seek
access to the following information:

Former Detective Constable Jon Wedger has provided information via a 
number of you tube videos taken at public events including the ITNJ 
Judicial Commission of Inquiry into Human Trafficking and Child Sex Abuse.

(1) One of the issues raised appears to relate to child prostitution and 
the death of a young girl.

The information provided suggests that a senior officer may have
committed  a criminal offence of misconduct in public office by
suppressing an  intelligence report and intimidating MrWedger. 

 The report submitted by Mr Wedger is believed to have highlighted that a 
known prostitute involved in recruiting children for prostitution was 
connected with high ranking senior officers, a Magistrate and someone in 
an executive position at the BBC.

(2) A further concern was raised concerning sex offenders avoiding 
registration by residing on canal boats. Mr Wedger states he was provide 
with 2 names via the prison service and was tasked to find more within a 
set period of time and apparently located 90 sex offenders.

Mr Wedger was informed that the investigation was apparently being shut 
down due to funding issues.

Please provide information as to the remit of the investigation, the 
outcome (report) and what action was taken subsequently to deal with the 
problem identified of sex offenders utilising canal boats to live on and 
move around to frustrate the registration process.

SEARCHES TO LOCATE INFORMATION

 

To locate the information relevant to your request searches were conducted
within the MPS.  The searches located information relevant to your
request.

 

In the first instance, on 28/01/2019 we wrote stating that Question 3
exceeds the cost threshold in determining what information is held. As a
reminder you had requested: 

 

(3) This is a public interest matter for several reasons including that 
one of the senior officers complained of is now believed to have been 
promoted to a Chief Constable in charge of a different police force.

“please provide a copy of the outcome of any IPCC investigation concerning
the matters raised above specifying whether any such investigation was
conducted locally, supervised, managed or conducted by the IPCC
themselves.”

 

We have reviewed your previous request and can advise that this decision
was an oversight on our part, this should not have been a cost refusal, I
apologise for this error. My response to your new request now incorporates
Q3.

 

DECISION

 

Having located and considered the relevant information, I am afraid that I
am not required by statute to release the information requested. This
response serves as a Refusal Notice under Section 17 of the Freedom of
Information Act 2000 (the Act) by virtue of the following exemptions:

 

Section 40(2) – Personal Information

Section 30(1)(a)(b) - Investigations

 

Section 40 - Personal Information are absolute exemptions which means that
the legislators have identified that harm would be caused by any release.
In addition there is no requirement to consider the public interest test.

 

Section 30 – Investigations and proceedings conducted by the public
authority exemptions are class based and qualified, I am required to
provide you with evidence of harm in releasing the information and conduct
a Public Interest Test in order to demonstrate our assessment as to
whether or not it is in the public interest to disclose the requested
information.

 

Please see the legal annex for the Public Interest Test on the exemptions
applied in respect of your request.

 

 

REASONS FOR DECISION

 

The exemptions applied is utilised in Q3.

 

With regards to Q2 – The requested information is not held by the MPS. The
investigation came under Op Tanner, and was run by the NCIS at the time.
The NCA would be the appropriate body to direct your enquiry to. However,
the NCA is not listed in Schedule 1 of the Freedom of Information Act
2000, and as such is not obliged to respond to Freedom of Information
requests. Any information from, or relating to the NCA has an absolute
exemption from disclosure by other public authorities by virtue of Section
23 of the Act (as amended by the Crime and Courts Act 2013). I have

Data Protection Act

 

Section 3 of the Data Protection Act 2018 confirms that information which
relates to an identified or identifiable living individual is Personal
Data.

The Freedom of Information Act provides an exemption for Personal Data and
this is known as the section 40 exemption.  

The information sought under your Freedom of Information request includes
the following which we consider to be Personal Data

A copy of the outcome of any IPCC  investigation concerning the matters
raised above specifying whether any  such investigation was conducted
locally, supervised, managed or conducted  by the IPCC themselves.

 

Where the request is seeking access to third party personal data the
section 40(2) exemption may be engaged.  

In order to apply the Section 40(2) exemption the disclosure of the
requested information must satisfy either the first, second or third
conditions as defined by subsections 3A, 3B and 4A of the Freedom of
Information Act 2000 (as amended by Section 58 of the Data Protection Act
2018).  

The first condition ensures that the exemption would apply in
circumstances where the disclosure of the information would breach any of
the Data Protection Act 2018 principles.

There are six Data Protection principles set out in the 2018 act and these
can be found at section 34.  

In this instance I have decided that the disclosure of the Personal Data
would be incompatible with the first Data Protection principle which
states that the processing (in this case the disclosure) of the data must
be both lawful and fair.

The basis for determining whether such a disclosure would be lawful and
fair is outlined under section 35 of the 2018 act which states that the
subject of the data must have given his/her consent for disclosure or the
processing must be necessary for the performance of a task carried out by
a competent authority.  As we do not have consent for the disclosure of
personal data and the disclosure is not necessary for any law enforcement
purposes it would not be considered lawful processing.  Such a disclosure
would therefore contravene the first data protection principle.

I have applied the exemption provided under Section 40(2) of the Freedom
of Information Act to this information as the first condition, defined in
subsection 3(A)(a) of Section 40 has been satisfied.  

This exemption is both absolute and class based. When this exemption is
applied, it is accepted that harm would result from disclosure.

LEGAL ANNEX

 

Section 17(1) of the Act provides:

 

(1)      A public authority which, in relation to any request for
information, is to any extent relying on a claim that any provision in
part II relating to the duty to confirm or deny is relevant to the request
or on a claim that information is exempt information must, within the time
for complying with section 1(1), give the applicant a notice which-

 

(a) states the fact,

(b) specifies the exemption in question, and

(c) states (if that would not otherwise be apparent) why the exemption
applies.

 

Section 40(2)(3)&(4) of the Act provides:

(2)        Any information to which a request for information relates is
also exempt information if-

(a) it constitutes personal data which do not fall within subsection (1),
and
(b) either the first or the second condition below is satisfied.

(3A)        The first condition is that the disclosure of the information
to a member of the public otherwise than under this Act-

(a) would contravene any of the data protection principles, or
(b) would do so if the exemptions in section 24(1) of the Data Protection
Act 2018 (manual unstructured data held by public authorities) were
disregarded.

(3B)       The second condition is that the disclosure of the information
to a member of the public otherwise than under this Act would contravene
Article 21 of the GDPR (general processing: right to object to
processing).

(4A)        The third condition is that-

(a) on a request under Article 15(1) of the GDPR (general processing:
right of access by the data subject) for access to personal data, the
information would be withheld in reliance on provision made by or under
section 15, 16 or 26 of, or Schedule 2, 3 or 4 to, the Data Protection Act
2018, or
(b) on a request under section 45(1)(b) of that Act (law enforcement
processing: right of access by the data subject), the information would be
withheld in reliance on subsection (4) of that section."

 

Section 30(1)(a&b) of the Act provides:

1) Information held by a public authority is exempt information if it has
at any time been held by the authority for the purposes of-
(a) any investigation which the public authority has a duty to conduct
with a view to it being ascertained-
(i)whether a person should be charged with an offence, or
(ii) whether a person charged with an offence is guilty of it,

Section 30 is a classed based & qualified exemption.  
This exemption can be applied following completion of a Public Interest
Test (PIT).

Public Interest Test

Section 30 Evidence of Harm

The requested information and reports forms part of a wider operation
under Operation Winter Key.

It is held for the purpose of the overarching MPS’s response to the
Independent Inquiry into Child Sexual Abuse (IICSA), and provides
specialist capacity and capability to investigate high profile or complex
criminal investigations into non-recent child sexual abuse.

Disclosure of information obtained for an investigation could risk the
identity of the victims and those who may have assisted police being
revealed. This may affect any ongoing investigations into similar cases
and could undermine the confidence in the police.

Section 30 Public interest considerations favouring disclosure

Disclosure of this information would enlighten members of the public as to
the action taken by the MPS during investigations. This may go some way to
promoting awareness and accountability where expenditure of public funds
is concerned and would reinforce the MPS's commitment to openness and
transparency.

Section 30 Public interest considerations favouring non-disclosure

The MPS is unable to disclose information which has been or is being used
as part of an investigation.  There is a legal requirement to refrain from
disclosing information which would place the integrity of an investigation
or any future investigations at risk.  Once the investigation or legal
process is complete, some information may be deemed suitable for
disclosure.

In addition, disclosure of the information requested could identify living
persons captured by the scope of this request.  Individuals could analyse
the information (and along with local knowledge and information already
disclosed) identify those concerned as part of the investigation.  
This would hinder the prevention and detection of crime and also prejudice
the MPS's ability to fairly conduct an investigation and future
investigations of this nature.

 

The MPS has a statutory role in establishing whether any person has failed
to comply with the law. It also, in reviewing police action in specific
cases, performs a key role in ascertaining whether any person is
responsible for any conduct which is improper. The requested information
that, whilst not held directly for the purpose of the criminal
investigation, is linked to this inquiry. The release of police
information that is linked to a criminal investigation and/or a subsequent
review of police action, would be likely to adversely impact upon the
ability of the MPS to obtain information in connection with future
investigations and/or inquiries. This would occur because those involved
directly or indirectly in the investigation, would not expect the MPS to
make this information available under the Freedom of Information Act. Over
time, the perceived breach of trust that would result from the release of
information of this nature, would be likely to adversely affect the
ability of the police to obtain information in connection with future
investigations/inquiries. This would be contrary to the public interest. 
 

 

Evaluation

In assessing your request, I have also evaluated the harm that release of
sections of the case file would be likely to cause. I consider that the
release would be inappropriate and in contradiction of the purpose for
which the information is held. In addition, the release of sensitive
information held in connection with this investigation would not be
anticipated by those connected to the investigation. Should the MPS
release information of this nature, it would be likely to erode the trust
that exists with those involved in the investigation. Over time, this
erosion of trust would be likely to affect the ability of the police to
obtain information in connection with future investigations/inquiries.

After weighing up the competing interests I have determined that the
disclosure of the requested information would not be in the public
interest.  I consider that the benefit that would result from the
information being disclosed does not outweigh disclosing information
relating to your request.
