Dear Highways England Company Limited,

Following the NSoRC (National Schedule of Rates Schedule) trial withdrawal, you have written:

What happens next? We will revert to pursuing claims based on the actual cost of carrying out the repairs and will continue to explore options for a transparent and equitable set of rates.’

Kier Highways are now submitting claims in a new manner, referring to CECA. Naming this KSoR – Kier Schedule of Rates.

Please provide all information leading up to this change; the exchanges between Kier Highways and Highways England and copies of the related agreements, amendments to the contract, Deeds of Variation etc. to the existing ASC Contracts.

Please provide a copy of the full schedule of rates that have been agreed.

Please provide the Deeds of Variation that specifically deal with how Third Parties are to be charged.

The information will address why it was considered an amendment was required and include the DCP repair rates agreed between Kier and Highways England for above-threshold works and why, if it is the case, that you are not subject to the new rates.

If there have been no changes to the existing Kier ASC contracts please confirm and clarify this.

Please note that these provisions ( Appendix A, Annex 23) have been superseded and no longer apply. Kier Highways now price unscheduled damage claims using a fixed schedule of charges, derived from first principles using the Construction Industry Joint Council (CIJC) Working Rule Agreement and Civil Engineering Contractors Association (CECA) Schedules of Equipment Rates. These are both nationally recognised standards.

Kier Highways have our agreement to adopt this approach. The invoices they send will now be accompanied by a statement detailing the resources and associated rates which have been applied. Further details concerning these changes will shortly be provided by Kier Highways in their updated guide to insurers.

These changes do not affect any cases where legal proceedings have already been issued. These have been priced using the procedure set at Appendix A to Annex 23. This includes the cases before Cardiff County Court to which you refer.
