Proposal to vary Community Water Fluoridation arrangements in Cumbria
Cumbria County Council (“the Council”) proposes that water fluoridation arrangements be varied to reflect a change in the water sources to be fluoridated and, as a consequence, change the area of the arrangements.
In accordance with Section 88J of the Water Industry Act 1991, as amended, the Council now seeks your opinion as to whether the arrangements as varied in accordance with the above proposal would be operable and efficient.
In accordance with paragraph (2) of the above section the Council has consulted with United Utilities (UU, the water undertaker) as to whether the arrangements as varied in accordance with the proposal would be operable and efficient.
In accordance with paragraph (5) we enclose the opinion of UU on this matter and further details of the proposal. The opinion of UU is that the water fluoridation arrangements as varied in accordance with the proposal would be operable and efficient. We must stress that UU have disclosed their opinion to us on the basis that it is solely used for the purpose of consulting with you and have sought assurances that it will not be made available publicly due to content which may be exempt from disclosure under FOI and/or EIR provisions. Where such a request is made for disclosure a redacted version of the report could be supplied for such purposes. UU can be contacted directly via their Chief Scientific Officer, Charmian Abbott
In accordance with paragraph (2) of the above section we now seek your opinion as to whether the arrangements as varied in accordance with the proposal would be operable and efficient.
We have worked closely with Public Health England (now the Office for Health Improvement and Disparities) in this matter.

from CCC 5/10/2021, which was received on 23/01/2022.

The council aims to provide you with the information within the statutory
timescale of 20 working days in this case the date is 18/02/2022.
Subject to the information not being exempt or containing any references
to third parties.

The council will, as a matter of routine make information available in
electronic format. Where it is not practical to do this information will
be provided in hard copy (paper). If information is required in
alternative formats e.g. language, audio, large print, etc., please
indicate this as soon as possible so the council can consider your
request.

The Freedom of Information Act 2000 define a number of
exemptions/exceptions which may prevent information being released to you
automatically. The council will make an assessment about the application
of any exemptions/exceptions and issue you with a decision letter, which
will include details of your right to appeal.

If the information you request contains reference to a third party the
council will consult with them prior to making a decision about the
release of information.

In accordance with the council's Charging Policy a fee may be charged for
supplying information. If a fee is payable you will be issued with a fees
notice. The applicable fee must be paid in full before the information is
processed and released. The statutory time limit for responses is
suspended until the council has received and processed your payment. If
payment is not received within three months of issuing the fees notice
your request will be closed.

Dear Paul,

 

I am writing to inform you that I am extending the timescale for the above
request for a further 20 working days from the current deadline date 18^th
February 2022, taking us to 18^th March 2022.

 

“Regulation 7(1)(3) – requirement to notify the requester that the
authority needs an extension of time to deal with a request which is
complex or voluminous.”

 

The reason for this extension is due to the volume of work. I have
received  36 separate documents from the service, some with multiple pages
and each page needs reviewing and some need redacting manually which can
take 2-5 minutes per page. Some pages are emails which needed manually
converting to PDF to ensure the information is both non-editable and easy
to read.

 

In addition to the volume of work, I will also need to send out “Third
party consultations” as some of the information is about other
organisations. I will give the organisations a timescale in line with the
new deadline, which will allow them to get back to me with any objections
before we release this information.
