Reports of bullying

Please could you advise if there have been any allegations/complaints of bullying made against councillors in the past 5 years, whether these were made by staff or councillors, and the outcomes of the investigations?

The Council neither confirms nor denies that it holds information falling within the description specified in your request. The duty in Section 1(1)(a) of the Freedom of Information Act does not apply, by virtue of Section 40 (2) of that Act. This is an absolute exemption and there is therefore no requirement to consider the public interest.
Please consider this correspondence as a refusal notice under Section 17 of the Freedom of Information Act.

Are you not even able to confirm if there have been any complaints and how many in the past 5 years? There is no identifying information contained in that response that would constitute personal data.

Unfortunately, I am not able to confirm either way, due to the small
number of staff that the Council employs, to confirm, if this was the
case, could expose a member of staff's confidentially and thus would be a
breach of the Data Protection Act.
