(1) I'm told that the report has already been written and is complete. And
therefore the document is therefore one held by Haringey. Can you please
confirm or deny this is the case?

(2) If it has been written my understanding is that under the Freedom of
Information Act you are now required to send me a copy. And that Haringey
is therefore out of time.

(3) If on behalf of Haringey Council you are declining to supply me a
copy, please accept this email as a formal request for a review of
Haringey's decision so I can continue the process available - leading if
necessary to a referral to the Information Commissioner.

(4) Can you please copy this reply and all further replies to the public
website WhatDoTheyKnow.com through which I made the original F.o.I
request.

Dear Haringey Borough Council,

Thank you for this reply. Before I write to the Information Commissioner can I please ask you to clarify in which aspects the work of this report is "a draft" and how this means that it is necessarily "incomplete or unfinished material".

To me, this claim appears to me ambiguous, in that it can be interpreted in several different ways. For example it may be the case that:
(a) The consultant has concluded the work she was contracted to do and has delivered a report in draft form.
(b) The consultant may have completed part or parts of the contracted work, but is continuing to undertake the remaining work specified.
(c) The report of the original work contracted to be done has led to supplementary work which is now underway.
(d) Alternatively the consultant may have concluded her work and produced a report which contains factual information and recommendations which are inconvenient and/or embarrassing to someone in the Council who therefore wishes to see amendments made to the original report.

This list is not exhaustive.

I would therefore appreciate some concrete information which would enable me to identify the precise position so I can request a ruling from the Information Commissioner's Office.

In particular it may be helpful if you can supply me with:
(1) a copy of the terms of reference given to the consultant i.e what was she actually asked to do?
(2) The dates when the work was given to the consultant by Haringey and the date she started. And whether or not she is still currently engaged in this work. If not the date she completed the work.
(3) If she has only partially completed the work, which parts of the original specified task remain to be done? And when is it anticipated that the work will be completed?

As all this information will be readily and easily available I anticipate an early reply.

The report is still a work in progress and is expected to be finalised by
early June.   

 

The Consultant was hired as an advisor to support the assessment and
production of the report. The consultant has produced various tables and
matrixes – aides to assessment and improvement – but these are not yet
complete.

 

If you are dissatisfied, you may complain to the Information Commissioner,
who may be able to help you.  Please note that if you wish to refer this
case to the Information Commissioner, they ask that you do so within two
months of our response to you.

Can I please ask for your help.

As you probably know, last night a Report was presented at the Regulatory Committee. Its snappy title is: Development Management (DM) Performance Assessment: Improvement Actions taken December 2012 – March 2013 and Proposals for 2013-14.

Paragraph 3.4 of the report states that "During Summer 2012 a review of DM was undertaken". Para 3.5 states that: "The DM review was commissioned from Fortismere Associates..."

You may not know that on 6 February 2013 through the website WhatDoTheyKnow.com I made an FoI request for a copy of the Report by Alison Blom-Cooper of Fortismere Associates. My Freedom of Information Act request was redefined by officers as a request under the Environmental Information Regulations (no reason given) and refused. The reasons for refusal were that it was incomplete or not yet approved by the "cabinet" and this would not happen until "early June".

I asked for an internal review. The refusal was confirmed.

I was advised I could apply to the Information Commissioner. To enable me to do this, I requested some clarification; and on 8 April asked for the following:
(1) a copy of the terms of reference given to the consultant i.e what was she actually asked to do?
(2) The dates when the work was given to the consultant and the date she started. And whether or not she is still currently engaged in this work. If not the date she completed the work.
(3) If Ms Blom-Cooper has only partially completed the work, which parts of the original specified task remain to be done? And when is it anticipated that the work will be completed?

These questions were ignored. However, in response on 12 April - only 12 working days ago - I was advised that:
"The report is still a work in progress and is expected to be finalised by early June."
"The Consultant was hired as an advisor to support the assessment and production of the report. The consultant has produced various tables and matrixes – aides to assessment and improvement – but these are not yet complete."

The Report to the Regulatory Committee last night refers to a Review "during Summer 2012", I've not spotted a reference to this being incomplete, nor to ongoing work.

I gather that last night several members of the Regulatory Committee queried why they were being given only a summary and action points and not the full Review. The report to the Committee is highly critical of the record of Haringey Planning Service and it's difficult to see how the full Review could be worse. But I may be mistaken.

However, since the Regulatory Committee at a public meeting has at least had some of this material - which included "various tables and matrixes" - I can't understand the reasons for withholding the report/Review in response to my F.o.I. request.

I look forward to your help not only in resolving this particular problem but also in making clear to senior council officers in the Planning and Regeneration Service that Freedom of Information Requests need treating with due seriousness.
