Removal of VERY temporary cycle lane

Dear South Gloucestershire Council,

With regard to the VERY temporary cycle lane on A4174 in Filton recently installed and removed a few days later, please provide the following information / documents:
a. criteria used for determining a temporary cycle lane should be installed
b. copy of correspondence and complaints regarding the temporary cycle lane
c. correspondence to/from Ward Councillors regarding the temporary cycle lane
d. total costs (including SGC staff time) for the design and implementation of the cycle lane
e. total costs (including SGC staff time) for the removal of the cycle lane
f. notice of decision, or similar document, authorising / instructing that the cycle lane be removed

The above is all very recent, and so the information should be easily to hand. I hope, therefore that you will be able to fully respond within the next seven days.

Thank you for your email which I will forward to the Officer allocated to respond to your request.

I appreciate that you are keen to get a response and can see that your acknowledgement advised that Officers were extremely busy at the moment and that there may be a delay to responding. I can also advise you that even if there wasn’t a delay due to the COVID-19 pandemic, the target date for response to information requests is within 20 working days. Your request was received on the 5th June and acknowledged the same day. The target date for a response under normal circumstances would be the 3rd July.

Officers will respond when they are able to.

Dear South Gloucestershire Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of South Gloucestershire Council's handling of my FOI request entitled 'Removal of VERY temporary cycle lane'.

The Council has failed to provide the information "promptly" as required by the Freedom of Information Act and has also failed to provide the information requested information that MUST, by law, be provided within twenty working days.

Please conduct an Internal Review of the Council's failure to comply with statutory legislation, and also provide the information requested. While some of your staff may be working from home etc, this does not affect the Council's statutory responsibilities under the Freedom of Information Act. With many of the Councils facilities currently closed, there should be a surplus of staff available to assist the FOI team.

Thank you for your email requesting a review due to lack of response to
your information request ref FIDP/014802-20.
 
The chronology for your request is:
 

* Friday 5th June 2010 11:47hrs - request received.
* Friday 5^th June 2020 14:47hrs – request acknowledged and, in line
with the Information Commissioners Office guidance,  advised that:

 
‘You will be aware of the current health emergency and impacts of
Coronavirus (COVID-19) across the country. The Council provides many
complex services, which our residents and communities rely on, providing
essential support to protect the most vulnerable. This means, during this
time, we may not be able to respond to your request within the usual 20
day period.’
 

* Saturday 20^th 2020 18:03hrs – email chasing response from requestor.
* Monday 22^nd June 08:44hrs – response from SGC:

 
‘I appreciate that you are keen to get a response and can see that your
acknowledgement advised that Officers were extremely busy at the moment
and that there may be a delay to responding. I can also advise you that
even if there wasn’t a delay due to the COVID-19 pandemic, the target date
for response to information requests is within 20 working days. Your
request was received on the 5th June and acknowledged the same day. The
target date for a response under normal circumstances would be the 3rd
July.’
 
      Officers will respond when they are able to.
 

* Saturday 4^th July 2020 12:26hrs – email requesting review due to late
response.

 
Whilst I appreciate that you are keen to receive the information
requested, it has been explained to you that the Council could not confirm
when a response would be provided. A response is being prepared but
requires input from Senior Managers who have been extremely busy
responding to the COVID-19 pandemic. I am unable to provide you with a
date when the response will be provided to you but I would hope it would
not be too much longer.
 
If you remain unhappy following this explanation you may contact the
Information Commissioner’s Office.

Thank you for your response to my FOI request.

I have looked at the documents provided. It appears that the Council received just ONE email complaint regarding the cycle lane (excluding comments from Councillors and SGC staff). Is that correct?

I find it amazing that the Council should withdraw such a scheme after such minimal negative feedback from local residents and users of the road.

The correspondence that officers had was included, the decision makers would have also had feedback that we were not sighted on.

Thank you for your clarification, and for confirming that Council Staff received only ONE complaint (other than by SGC staff and Councillors).

It seems that SGC is yet to provide all the information I requested. You are reminded that my FOI included a request for:
b. copy of correspondence and complaints regarding the temporary cycle lane
c. correspondence TO/FROM Ward Councillors regarding the temporary cycle lane

If SGC received correspondence via your Councillors then this was specifically included within my FOI request.

When do you anticipate providing the outstanding information?
