Release of information to journalists

Dear Criminal Cases Review Commission,

A concern was raised regarding a reporter from the Portsmouth News obtaining information about an individual's case.

The response from the CCRC was :
"It is our established practice to give a factual update about the status of a case if a journalist calls and asks about it by name.
This will include basic details such as when the person applied, what the application related to (i.e. the offence an or sentence). In the event that the case is closed, we will say so and say whether or not it has been referred for appeal."

Please provide a copy of any policy and related documents to show how the CCRC deem this to be compatible with DPA/GDPR when the individual believed his dealings with the CCRC were confidential.

Dear HMPG,

 

Thank you for your email which arrived via the What Do they Know website
on 11th December.

 

In it you ask, under the Freedom of Information Act 2000, for:

 

"a copy of any policy and related documents to show how the CCRC deem this
to be compatible with DPA/GDPR when the individual believed his dealings
with the CCRC were confidential."

 

The CCRC External Communications strategy is published on the CCRC website

contains the following line in relation to media enquiries from
journalists:

We will: provide information as appropriate in order to assist journalists
to produce accurate, informed and interesting news and current affairs
content relating to CCRC cases and other business.

 

It seems likely that what you are most interested in is the lawful basis,
within the Data Protection Act 2018 and  GDPR, upon which the CCRC relies
in order to supply such information to journalists.

 

We rely on exemptions based on article 85(2) Freedom of Expression of the
GDPR. These appear in UK domestic law under part 5 to Schedule 2 of the
Data Protection Act 2018. Specifically at section 26 which deals with
journalistic purposes.
