I request information on: THE (NEW) STANDARD CONTRACTUAL TERMS FOR THE SUPPLY OF LEGAL SERVICES BY BARRISTERS TO AUTHORISED PERSONS 2012 – ANNEXE T TO THE BAR CODE OF CONDUCT
As I am aware from 31.01.13 the way a solicitor instructs a barrister changed and ANNEX T came into force replacing ANNEX G.
I note that all payments would now be from the solicitors not the Legal Aid Agency and that applied to all Civil Cases that when a new set of instructions or brief was prepared.
Can you inform me if this also applied to the Family Advocacy Scheme? Were barristers from 31.01.13 providing their services under ANNEX T, when providing family services under the Private Law programme?
This issue is not clearly set out in any document I can see.
If a Legal Aid Certificate was granted prior to 31.01.13 but a set of new instructions and a new brief was prepared would the terms be under ANNEX T or ANNEX G? and if so did this apply to the Family Advocacy Scheme where Barrister was paid via the Legal Aid agency for there work?
Please provide the contractual agreement between a barrister who is self employed who would be paid under the FAS scheme and the relationship with the solicitors who was taking on work under the FAS scheme, which appear to suggest ANNEX T?
Please can I have this information in the time requested and sooner if possible?
