Reinstatement Committee & Umpires (Reserve Forces)

Dear Sir/Madam,

I write to ask if the MoJ is the relevant department which holds information on Reinstatement Committees ("RC") constituted under section 8, and Umpires and Assessors under section 9 of the Reseve Forces (Safeguard of Employment) Act 1985?

If so, would you be able to provide the following information:

(1) Statistics for the years in which they are held relating to:
(i) The number of applications made under sections 3 or 7 of the 1985 Act as the case may be,
(ii) the number of cases determined at a hearing or otherwise,
(iii) in the case of applications under section 3 whether or not reinstatement was ordered under section 8 (2) (a) in decided cases, and
(iv)in all decided cases whether or not an order was made under section 8 (2) (b);

(2) The number of oral hearings for the years in which figures are held;

(3) The number of, and locations where, RCs holds oral hearings;

(4) Who has been appointed to the various positions in schedule 2 to the 1985 Act;

(5) How appointments under schedule 2 are made and advertised (if appropriate);

(6) Where decisions made by either the RC or Umpires are available from and the process by which they may be obtained.

If the MOJ is not the responsible department for this information, I would be very grateful if you were able to inform me which is the correct department.

Regarding your request for clarification about whether another Department had responsibility for recording Employment Tribunals statistics requested before the financial year 2008-09, and if so, which department it was.
I have to tell you that up until 2006, Employment Tribunals was managed by The Department of Business Innovation and Skills (BIS) or The Department of Trade and Industry as it was.

Dear Mr Weston,

Thank you for your email. On the basis of your email, it would appear that HMCTS should hold statistics on reinstatement committees for the finanical years 2006-07 to 2007-08 as you have noted that responsibility only transferred to HMCTS in 2006. The inoformation I have been provided with only relates to the financial years 2008-09 onwards.

Assuming the information you have provided me with is correct, I believe that I should have been provided with this information as part of my original request, or alternatively, another deparment other than BIS, BERR, DTI (as a single successor Department) or MoJ holds the information.

Please can you confirm which of the above alternatives is correct? Failing this, I regret that I may have to make a fresh FoI request.

Hello Mr Jackson,
I have now carried out extensive enquiries and can tell you that although this became the responsibility of DCA / MoJ in 2006, for the period 2006-2008, other than that already supplied to you, the Ministry of Justice does not have any record of any Applications or Cases Determined by Reinstatement Committees.
I can confirm that although we did we didn't collate statistics until 2008 we cannot backfill and no longer retain the data. I am sorry that I have not been able to help further.
You are, of course, able to submit a new Freedom of Information Act Request should you so wish.
