Regulatory rules re process server failing to supply proper verification

Legal Services Board did not have the information requested.

Dear Legal Services Board, I am trying to get the fee paid to Kent Legal Services for serving of divorce paperwork to my wife refunded as I have been trying for over a year to get the necessary sworn affidavit of service without success-what they actually sent me was an un-notarized copy of the paperwork my original lawyer prepared with my friend’s name (who sent them the paperwork because he was unable to serve it) as the server, and in spite of dozens of emails on my part and promises from them on numerous occasions that it had been/would be done I never received anything else.....

Yours faithfully,
Mike Kelly

BoardSecretary, Legal Services Board

Dear Mr Kelly

Thank you for your email to the Legal Services Board dated 15 March 2021, which we are treating as a complaint about how your case has been handled by Kent Legal Services rather than as a request for information.

It will assist my response if I briefly set out the role of the LSB.  We were created by the Legal Services Act 2007 as an independent body to oversee the regulation of legal services in England and Wales. We do not have any remit over legal fees. You may like to seek independent legal advice for this.

If you are unhappy with the service you have receive, you can complain direct to the service provider, and you may be able to make a service complaint via the Legal Ombudsman. More information about how to make a complaint is available on their website. https://www.legalombudsman.org.uk/make-a...

I hope this information is helpful.

Yours sincerely

Steph
