Dear Legal Aid Agency,

Please can you confirm whether the statutory charge, applied on the basis of the Section 16(6) Legal Aid Act 1988 is subject to the Consumer Credit Act 1974. If the loan (by way of the statutory Charge) is not regulated by the Consumer Credit Act 1974 (as subsequently amended) please can you confirm the basis of the exemption from this consumer protection legislation.

Please can you also confirm if the statutory charge is subject to any consumer protection legislation or obligations. If there is any legislation/ regulations/ guidance which regulates how the statutory charge should be administered and managed, please can you let me know

I assume this information is easily available and would appreciate a prompt response.
