Dear Scottish Government Health and Social Care Directorates,

I shall be grateful if you will provide information as follows:

1) What body, or bodies, exist to oversee medical standards and quality of administrative work in both hospitals and NHS Boards in Scotland?

2) In the event of a person finding medical standards of serious concern and a poor administrative quality of work in an NHS Board, plus hospital run by that Board, to whom should they contact with a view to having these investigated?

3) An NHS Board states they do not investigate all complaints submitted to them. They decide which one they will look at and ignore the rest. The figures of complaints provided in their report are only for complaints responded to, not complaints received. Is this in accordance with requirements in Scotland?

4) People who complain and do not have their complaints investigated are not advised of this fact. The NHS Board claims they advise people their complaints are not going to be examined. The reality is they do not. Is this lawful and in accordance with requirements in Scotland?

5) Complaints are submitted to an NHS Board under the NHS Complaints procedure. They state they deal with complaints (only the ones they choose to) under the complaints system of the Scottish Public Services Ombudsman's model complaints handling procedure. Is this permissible under the requirements on NHS Boards in Scotland? Do they need to comply with the NHS Complaints Procedure if the complainant states a complaint is being made under the terms of this?

6) Given this Board pays no regard to their patients, regulations, good medical practice , or just about everything else, who is able to regulate them?

7) Is there any document which outlines the requirements for NHS Boards in respect of the above? Please provide this if it exists.
