Dear Sir/Madam,

Request for Information – Freedom of Information (Scotland) Act 2002

Registered Third Parties

I refer to your e-mail of 28^th January 2018, in which you request, under
the terms of the Freedom of Information (Scotland) Act 2002, certain
information in connection with registered third parties regulated by the
Electoral Commission.

Your request for information is in the following terms;

“For the years 2016 and 2017, please provide details of registered third
parties - regulated by the Electoral Commission – that have requested
electoral registers and/or electoral register updates, overseas voters
list, and/or absent voters lists”.

I have endeavoured to provide information in relation to your request
where such information exists. However, where such information exists and
I have not provided it, this e-mail constitutes a refusal notice within
the terms of Section 16 of the Freedom of Information (Scotland) Act 2002.

Prior to responding to your request it is worth pointing that the
Electoral Registration Officer and the services that she provides is not
subject to Freedom of Information legislation and therefore, strictly
speaking, I am not required to respond to your request for information.
However, in a spirit of openness and co-operation the Electoral
Registration Officer is on this occasion prepared to provide the requested
information.

Therefore, as requested, I can confirm that the details of the registered
third parties – regulated by the Electoral Commission – that have
requested electoral registers and/or electoral register updates, overseas
voters lists, and/or absent voter lists from the Electoral Registration
Officer for Ayrshire Valuation Joint Board during 2016 is shown in the
table below. I can also confirm that we did not receive any similar
requests during 2017.

As required by the Freedom of Information (Scotland) Act 2002, I would
advise you that if you are dissatisfied with the way in which this request
has been dealt with you may apply to have this decision reviewed as
detailed within Section 20 of the Act. In order to do this you must apply
to the Assessor, in writing or other permanent means, stating your contact
details, your request and the reason why you are dissatisfied. Any such
application must be made within 40 working days of receipt of this notice.

Should you remain dissatisfied following such a review then you are
entitled to appeal, within the terms of section 47(1) of the Act, to the
Freedom of Information Commissioner for a decision by the Commissioner.
The Commissioner can be contacted at:-

Kinburn Castle,

Doubledykes Road,

St. Andrews,

Fife, KY16 9DS.

Telephone: 01334 464610

The Commissioners Appeals Online service gives you help in real time,
explaining exactly what the Commissioner needs to investigate your case
quickly.  The direct link to this service is on their website:
