Provision of information held by Northumbria Police made under the Freedom
of Information Act 2000 (the 'Act')

Thank you for your email dated 29th July 2011 in which you made a request
for access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.

You asked:

"1. The number of times legal action of any kind has been suggested by NPs
legal team to any outside party or parties concerning potentially
defamatory material during past 2 years?
2. A listing of all/any instances, regards 1 above, including date and type
of supposed violation: eg infringement of trademark, copyright
infringement, defamation/libel etc.
3. Copies of all communication, documents from NP in which legal action was
threatened, regards 1 above, and the end result (ifany).
4. A listing of all cases in which legal action was brought or settled,
regards 1 above, during past 2 years
5. If any settlement was made, the costs of these settlements, as 1 above,
during past 2 years"

In response:

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

Following receipt of your request, searches were conducted with the Legal
Department of Northumbria Police. I can confirm that the information you
have requested is not held by Northumbria Police.
There have been no such instances.

Please note this request has been aggregated with FOIs 538/11, 535/11 and
472/11 submitted by other members of your group on the same subject matter.

The Fees Regulations state that two or more requests to one public
authority can be aggregated for the purposes of calculating costs if they
are:
· by one person, or by different persons who appear to the public
authority
· to be acting in concert or in pursuance of a campaign;
· for the same or similar information; and
· the subsequent request is received by the public authority within 60
working days of the previous request.

The intention of this provision is to prevent individuals or organisations
evading the appropriate limit by dividing a request into smaller parts.

Please note that further requests on this subject area may be declared
vexatious under Section 14 of the Freedom of Information Act 2000 and we
provide an explanation to this exemption.

Section 14 (2) Vexatious Requests - Where a public authority has previously
complied with a request for information which was made by any person, it is
not obliged to comply with a subsequent identical or substantially similar
request from that person unless a reasonable interval has elapsed between
compliance with the previous request and the making of the current request.

However, the ‘reasonable interval’ is not defined but it is suggested that
60 working days may be a useful benchmark.

The information we have supplied to you is likely to contain intellectual
property rights of Northumbria Police. Your use of the information must be
strictly in accordance with the Copyright Designs and Patents Act 1988 (as
amended) or such other applicable legislation. In particular, you must not
re-use this information for any commercial purpose.

How to complain

If you are unhappy with our decision or do not consider that we have
handled your request properly and we are unable to resolve this issue
informally, you are entitled to make a formal complaint to us under our
complaints procedure which is attached.

(See attached file: FOI Complaint Rights.doc)

If you are still unhappy after we have investigated your complaint and
reported to you the outcome, you may complain directly to the Information
Commissioner’s Office and request that they investigate to ascertain
whether we have dealt with your request in accordance with the Act.

Yours sincerely

Dear Northumbria Police,

In your 9/8/11 response you wrote, “Please note this request has been aggregated with FOIs 538/11, 535/11 and 472/11 submitted by other members of your group on the same subject matter.”

Under FOIA, ‘Duty to provide advice and assistance’ I am seeking such advice and assistance from Northumbria Police relating to;

A, Please forward me links to the requests that you have informed me have been ‘aggregated with FOIs 538/11, 535/11 and 472/11.’ Explain what above requests have to do with me and or this request.

You have also stated, “The Fees Regulations state that two or more requests to one public authority can be aggregated for the purposes of calculating costs if they are:
• by one person, or by different persons who appear to the public authority
• to be acting in concert or in pursuance of a campaign;
• for the same or similar information; and
• the subsequent request is received by the public authority within 60working days of the previous request.”

B, Given that none of the above relate to me nor my request can you explain why you have included this? I have already informed you that I am Martin McGartland’s partner of 13 years.

C, Supply me with all information you have concerning above, including full details of when request/s, ‘for the same or similar information’, was made and supply all links or copies of such requests.

D, In your reply you say, ‘ to be acting in concert or in pursuance of a campaign’, explain to me who I am acting in ‘concert’ with?

You also refer to a ‘campaign’ there is indeed a campaign, a campaign lead by your Chief Constable Sue Sim and Chief Supintendent Chris Thomson, the head of Northumbria Police’s Professional Standards Department, both are involved in serious corruption and criminal acts when dealing with Martin McGartland and his cases. There are also many others within Northumbria Police involved too.

The following links show that Northumbria Police contacted facebook to try to get information removed relating to Martin McGartland, his facebook pages. However, Northumbria Police are even covering that up too;

Again, this info is for others who may read this, other pages relating to the Chief Constable Sue Sim, Chief Supintendent Chris Thomson, Northumbria Police serious corruption, criminal acts and the cover-up into Martin McGartland's attempted murder, his cases.

As you are already aware, Chief Constable Sue Sim, Chief Supintendent Chris Thomson nor Northumbria Police have at no time taken any action against Martin McGartland regards above, Why? Because it is all fact, it is also true. They both continue with thir serious corruption, criminal acts and their cover-up in the Martin McGartland case/s. I myself have seen all of the evidence that shows both Chief Constable Sue Sim, Chief Supintendent Chris Thomson and Northumbria Police are involved in very serious corruption, criminal acts and a cover-up, (and a great deal more) in the Martin McGartland cases.

Long runs the fox.

I look forward to your reply.

Marty McGartland is single-handedly responsible for stopping at least 45 IRA bomb and assassination plots: http://politics.caledonianmercury.com/20... he saved the lives of at least fifty people and he put his own life in danger while doing so. As a result, the IRA kidnapped Martin 8th August 1991, Marty escaped certain death by jumping from a third floor window. Marty was moved to the UK mainland by British Government, however, for the past 20 years he has been hounded by the State, the Police, MI5 and others, simply because he wrote a book about his experiences; http://www.amazon.co.uk/Fifty-Dead-Men-W...

Marty was also shot at least 6 times by the IRA in June 1999, the IRA only found Marty's safe house after MI5, Northumbria Police and the CPS took a flawed and malicious prosecution against him, he was acquitted. However, during the court case Northumbria Police read out Martin's real name and even his home address. Marty's 1991 kidnapping has also been covered up for the past 20 years, The State (including RUC and PSNI) suppressed compelling evidence, evidence that would have resulted in his kidnappers being charged, the men were not even arrested, they were protected by the State for 18 years (until Marty make another complaint); http://www.scribd.com/doc/55567240/Top-P...

Northumbria Police, the Home Office, MI5, NIO, IPCC and many other organs of the State continue to cover up Marty's 1999 attempted murder too; https://www.facebook.com/MartinMcGartland

http://www.youtube.com/watch?v=UQhyxr0zd...

This is a total disgrace, it is also wrong, it is a State cover-up. Marty McGartland is in very poor health as a result, the State cover-up has and continues to exacerbate this. The protecting of IRA terrorists and the covering-up of both Marty’s kidnapping and his 1999 attempted murder by the above parties has now gone on for between 12 and 20 years. The above parties are hell bent on protecting IRA terrorists who were involved with both attacks. The above parties are also using every trick in the book, and many more, to cover up their own wrongdoing.

This is not the first time the British State have used the ‘National security’ tactic as an excuse for not giving a full response to controversial questions and allegations concerning their dealings with the 1999 attempted murder of ex- British agent Martin McGartland. This is what they do, they cover-up, they lie, they break the law and they are protecting the IRA terrorists who carried out the shooting of Martin McGartland, they have been doing so for the past 12 years. Just have a look at some of the dirty tricks of the British State; http://www.youtube.com/watch?v=11yk7p3Kp...
