2. A listing of all/any instances, regards 1 above, including date and type of supposed violation: eg infringement of trademark, copyright infringement, defamation/libel etc.

3. Copies of all communication, documents from NP in which legal action was threatened, regards 1 above, and the end result (if any).

4. A listing of all cases in which legal action was brought or settled, regards 1 above, during past 2 years

5. If any settlement was made, the costs of these settlements, as 1 above, during past 2 years

Provision of information held by Northumbria Police made under the Freedom
of Information Act 2000 (the 'Act')

Thank you for your email dated 29th July 2011 in which you made a request
for access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.

You asked:

"1. The number of times legal action of any kind has been suggested by NPs
legal team to any outside party or parties concerning potentially
defamatory material during past 2 years?
2. A listing of all/any instances, regards 1 above, including date and type

In response:

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

Following receipt of your request, searches were conducted with the Legal
Department of Northumbria Police. I can confirm that the information you
have requested is not held by Northumbria Police.
There have been no such instances.

Please note this request has been aggregated with FOIs 538/11, 535/11 and
472/11 submitted by other members of your group on the same subject matter.

The Fees Regulations state that two or more requests to one public
authority can be aggregated for the purposes of calculating costs if they
are:
· by one person, or by different persons who appear to the public
authority
· to be acting in concert or in pursuance of a campaign;
· for the same or similar information; and
· the subsequent request is received by the public authority within 60
working days of the previous request.

The intention of this provision is to prevent individuals or organisations
evading the appropriate limit by dividing a request into smaller parts.

Please note that further requests on this subject area may be declared
vexatious under Section 14 of the Freedom of Information Act 2000 and we
provide an explanation to this exemption.

Section 14 (2) Vexatious Requests - Where a public authority has previously
complied with a request for information which was made by any person, it is
not obliged to comply with a subsequent identical or substantially similar
request from that person unless a reasonable interval has elapsed between
compliance with the previous request and the making of the current request.

However, the ‘reasonable interval’ is not defined but it is suggested that
60 working days may be a useful benchmark.

The information we have supplied to you is likely to contain intellectual
property rights of Northumbria Police. Your use of the information must be
strictly in accordance with the Copyright Designs and Patents Act 1988 (as
amended) or such other applicable legislation. In particular, you must not

How to complain

Under FOIA, ‘Duty to provide advice and assistance’ I am seeking such advice and assistance from Northumbria Police relating to;

A, Please forward me links to the requests that you have informed me have been ‘aggregated with FOIs 538/11, 535/11 and 472/11.’ Explain what above requests have to do with me and or this request.

You also refer to a ‘campaign’ there is indeed a campaign, a campaign lead by your Chief Constable Sue Sim and Chief Supintendent Chris Thomson, the head of Northumbria Police’s Professional Standards Department, both are involved in serious corruption and criminal acts when dealing with Martin McGartland and his cases.
