Dear Bristol City Council,

Please provide all documents, communications and minutes arising out of the discussion, deliberation and decisions resulting from the Health and Safety Report before the Harbourside Forum which recommended the installation of railings at Princes Wharf/Mshed.

Please provide all documents, communications and minutes arising out of the discussion, deliberation and decisions not to install railings in the Princes Wharf/Mshed area of the city.

Would you kindly confirm if this request also includes Harbourside Forum material or will they require a separate application?

I accept that there will be duplication of documents relating to the two limbs of my request and am content for you to only to provide one copy in order to ease the administrative burden and for ease of analysis.

We can confirm that we have considered your request for information in
accordance with the Freedom of Information Act 2000 (FOIA), and in doing
so have identified that section 31(1)(c) (the administration of justice)
is engaged for some or all of the information that you have requested. 
Section 31(1)(c) of the FOIA confirms that:
 
31. (1)Information which is not exempt information by virtue of section 30
is exempt information if its disclosure under this Act would, or would be
likely to, prejudice -
              a) the administration of justice
 
The Public Interest in disclosing this information is outweighed by the
Public Interest in withholding the information. The matters considered in
coming to this decision are:
 
Disclose
1 The presumption of the Act is in favour of disclosure.
2 Public interest in the decision-making process surrounding the proposed
railings at Princes Wharf.
 
Withhold
1 The risk of prejudicing the Coroner's inquest into the death of a
cyclist who fell into the water in March.
 
This decision has been taken in line with the attached decision notice.
Bristol City Council will enter into dialogue with the Coroner with a view
to the requested information being released at such time as either: the
Coroner deems it not to be prejudicial to the inquest; or, the inquest is
completed.
