In Worcester a NHS dental practice closed in May 2016 having given just weeks a few weeks notice to thousands of of its patients (St Johns Dental Practice) It must be clear to NHS England that although for various reasons dental practices will sometimes close there is also a relationship of trust between dental patients and dentists, that can take sometimes years to build, that many people are fearful of dentists and so building a relationship with them can take time, and that without that trust they may fail to engage with dental care thus putting their oral and overall health at risk.

An article in the local press (Worcester Observer dated July 20th 2016) suggests this was a contract with an end date and that closure was well known in advance.

My questions are

1. Do you have information about why this dental contract was not renewed

2. Can you share the details of the contract through F of I

3. If the answer to question 2 above is no ( or in any event ) can you at least provide details as to what was required of the contractor to advise thousands of patients of pending closure ?

Is there a contractual term that specifies any precise or commended protocol as regards notification of pending closure ?

4. Can NHS England disclose how many NHS patients were listed with St Johns Dental Practice

5 Can it disclose any statistics as regards complaints made about this practice and with details of category of complaints ?

The provider was required to contact all of its patients by letter to
advise them that the practice was closing.

It is NHS England policy for the provider to contact its patients, the
provider understood this.

 

4.  Can NHS England disclose how many NHS patients were listed with St
Johns Dental Practice
It may help if we explain that dental practices do not hold patients lists
like GP practices. Patients are free to go to any practice at any time to
receive NHS dental care.

 

5  Can it disclose any statistics  as regards complaints made about this
practice and with details of category of complaints?

We have received 2 complaints about the practice. One complaint was
clinical and the other was non-clinical (closure of the practice).

Please note, we have considered your request in the context of your
previous enquiry (reference FOI-011342) and have therefore interpreted
‘the contract’ to relate to St Johns Dental Practice in Worcester. We
trust that this is an appropriate interpretation of your request.

We consider that individual variations on the standard contract, which are
unique to St Johns Dental Practice, Worcester, are exempt under Section
43(2) of the FOI Act. Section 43 exempts from the general duty to release
information which would, or would be likely to, prejudice the commercial
interests of any person, including the public authority holding the
information.

 

Section 43 is a prejudice based exemption and, as such, we are required to
assess both the prejudice test and the public interest test in withholding
this information against that of its release.

 

When assessing the prejudice test we need to demonstrate that there would
be an impact on the commercial interests of any person should this
information be disclosed.  We believe that to disclose the individual
elements of the contract would impact on the commercial interests of the
current contract holder.

 

Releasing this information would give competitors in any upcoming
procurement information which would not ordinarily be available. This
would distort the procurement process and disadvantage the current
contract holder.

 

As a result, it is in our opinion that this sufficiently demonstrates the
prejudice which would be caused through disclosure.

 

NHS England is also required to conduct the public interest test, which
assesses whether releasing the information would be in the public interest
despite the prejudice test being satisfied. It is important to bear in
mind that any disclosure under the FOI Act is a disclosure to the public
at large and not just to the applicant. We recognise that there is a
general public interest in health sector spend. However, we also consider
that there is a strong public interest in procurement processes being
conducted fairly and with appropriate due diligence.  Therefore, we
consider that releasing this information would not be in the public
interest, as the public interest does not outweigh the prejudice as set
out above.

The  dental contract that I requested is  a contract that has come to an

The FOI Management team have reviewed your request and this letter
provides an outcome of this review.

 

It was noted that your original response was issued over the statutory
guidelines of 20 working days. This fell short of our standards and we
would like to offer our sincere apologies for the delay incurred.

 

We have also assessed whether you had received an appropriate response to
your request and also considered the application of the exemption
contained in section 43(2) of the FOI Act 2000.

 

Section 43 exempts from the general duty to release information which
would, or would be likely to, prejudice the commercial interests of any
person, including the public authority holding the information.

 

We can advise that there was a procurement process (which included
re-provision of activity relating to this contract) ongoing between August
2016 and February 2017, and this was active at the time of your
request. The release of any sensitive information during this period could
have resulted in challenges and delays that could have jeopardised
services for patients at a number of practices across the West Midlands.
Releasing this information would give competitors in that procurement
process information which would not ordinarily be available. This would
distort the procurement process and disadvantage the current contract
