Dear Glyndŵr University,

Glyndwr purchased the Racecourse Stadium from Wrexham Village a few years back. The land purchased was then subject to a planning application (p/2008/1295 and 1296).The planning applications had Unilateral Undertaking attached.

In response to a recent FOI request (EIR6612) WCBC stated as follows.

Are the terms of the unilateral undertaking (UU) transferable to new owners of the development / land following a sale?

The Unilateral Undertaking runs with the development not the owners. Any new owners wishing to complete the development as approved will be subject to the terms of the Undertaking.

If the terms of the UU are not transferable, will the council seek to impose a similar sec 106 agreement on new owners once a sale of the development / land is complete?

The Unilateral Undertaking runs with the development so there will be no need for the council seek to impose a similar sec 106 agreement on new owners.

Glyndwr University now own the land that was set aside for phase 3 of the development.

Was the University made aware that there was/is a Unilateral Undertaking on this property ?

What are the Universities obligations in regards to the provision of a new spectator stand on the site that you now own ?

I've had a chat with the Director responsible for the Stadium and can clarify that

a) we own the car park, the footprint of the stadium itself and the little service road that runs between the University car park and the Stadium.
b) we do not own the land at the back of the Kop.
c) without seeing Phase 3 development proposals we are unable to categorically state if the Unilateral Undertaking is applicable to us:
i) if it relates purely to the footprint of the existing Kop then possibly - if this is the case then the Unilateral Undertaking would apply which is the University making a contribution to the Council in the form of planning contributions.
ii) if it relates to beyond that area then no as the land beyond it (i.e. behind it) is not ours

I suspect that Phase 3, if submitted by Wrexham Village as part of a 3 phase development, would extend beyond the footprint of the actual Kop. This is something you would have to pursue with the Planning Department of the Council I should imagine.

In terms of the last point in your request - I note it was not answered in the original response.

What are the Universities obligations in regards to the provision of a new spectator stand on the site that you now own ?

There are no obligations for the provision of a new spectator stand on that site. The site has now been leased to Wrexham Football Club on a long term lease.
