Purchase of Section 106 Affordable Housing by Sage Housing

We're waiting for Gareth Davies to read a recent response and update the status.

Dear Babergh District Council,

I write to you in order to request the information set out below. My request is pursuant to the FOIA.

The information requested relates to the purchase of Section 106 affordable housing units in the local authority area by the company Sage Housing over the last three years.

The information I seek is:

1) the number of applications made by Sage Housing to acquire Section 106 affordable housing units in each calendar year of 2017, 2018, 2019 and 2020.

2) the planning reference number that each application applies to

3) For each development in which Sage Housing has acquired Section 106 units between 01/01/2017 and 24/01/2020:

i) The name of the development
ii) The planning reference number
iii) The address of the development
iv) The postcode(s) of the development
v) The number of affordable units in the development
vi) The housing tenure mix (e.g social rent, affordable rent, shared ownership)
vii) The decision date (date/month/year)
viii) The date until when the units are contracted with Sage Housing to stay affordable
(date/month/year)
ix) The price paid by Sage Housing to acquire the development (if known)
x) For rental units, if the council has nomination rights to the first lets, what percentage of units will the council have nomination rights for on subsequent lets?
xi) List any requests made by Sage Housing to alter or amend the original Section 106 agreement and whether the council agreed to these.
xii) Whether the development is a completed or a forthcoming (“starts on site”) development

4) For each development please attach the viability assessment

5) For each unit acquired by Sage Housing:
i) The name of the unit’s development
ii) The unit’s address
iii) The price paid by Sage Housing to acquire the unit (if known)
iv) The Land Registry title number

Response:

1) the number of applications made by Sage Housing to acquire Section 106 affordable housing units in each calendar year of 2017, 2018, 2019 and 2020. - Housing associations make bids for the affordable homes within S106 agreements on a regular basis and they are under no obligations to tell the Council that they have bid for any specific schemes. The Council would only find out when they have had a bid accepted by the developer and they enter into a development contract. To date we have only been advised of one scheme where Sage are the confirmed RP and that was for year 2019. Nothing for 2017, 2018 or 2020 as yet.

2) the planning reference number that each application applies to - planning reference DC/18/01487

3) For each development in which Sage Housing has acquired Section 106 units between 01/01/2017 and 24/01/2020:

i) The name of the development - Gipping Mill, Great Blakenham Mid Suffolk
ii) The planning reference number - DC/18/01487
iii) The address of the development - Stowmarket Road, Great Blakenham
iv) The postcode(s) of the development - we don’t have this information.
v) The number of affordable units in the development - 45 dwellings
vi) The housing tenure mix (e.g social rent, affordable rent, shared ownership) - 13 shared ownership and 32 affordable rented.
vii) The decision date (date/month/year) 27.06.2018 Reserved Matters application.
viii) The date until when the units are contracted with Sage Housing to stay affordable - all affordable rented dwellings will be retained in perpetuity. Shared ownership Units are capable of the owner staircasing out to 100% but the capital receipt received by the RP between 81% and 100% equity must be retained by Sage and reinvested in Mid Suffolk on further affordable housing.
ix) The price paid by Sage Housing to acquire the development (if known) - This is commercially sensitive information and the Council are not given this information by the developer or Sage.
x) For rental units, if the council has nomination rights to the first lets, what percentage of units will the council have nomination rights for on subsequent lets? The Council will have a nomination agreement in place giving it 100% nomination rights on first lets and relets. The nomination agreement is currently being considered by Sage HA legal representatives.
xi) List any requests made by Sage Housing to alter or amend the original Section 106 agreement and whether the council agreed to these.
xii) Whether the development is a completed or a forthcoming (“starts on site”) development - the dwellings are in construction but the handover of some of the affordable units is expected before the end of this financial year.

4) For each development please attach the viability assessment - there was none as the Council's policy compliant requirement of 35% affordable hosuing was included by persimmon homes and the previous outline application.

5) For each unit acquired by Sage Housing:
i) The name of the unit’s development - see the answer to Q2 ii
ii) The unit’s address - see answer to Q2iii - we do not yet have road names or house numbers provided.
iii) The price paid by Sage Housing to acquire the unit (if known) - not known.
iv) The Land Registry title number - we do not have this. We only have the land transfer plan to Persimmon Homes but this does show the location of the affordable units - see attached.
