Public Rights of Way GIS Data

Dear Birmingham City Council,

You may recall a previous FOI/EIR request from me back in 2018, when I requested a copy of your Public Rights of Way GIS data. Details can be found at https://www.whatdotheyknow.com/request/p... . I also understand that around October 2020, your provided an updated copy to the person who runs the rowmaps.com website, which he has made available at http://www.rowmaps.com/datasets/BI/ .

Since that dataset is now over a year old, I would like to request an updated version. Specifically, under the Environmental Information Regulations I would like a copy of your Public Rights of Way GIS data, with a preference to receive it in a computer-readable electronic form such as a Shapefile or KML file. As before, under the Re-Use of Public Sector Information Regulations, I would like to request permission to re-use this information under the Open Government Licence v3. The purposes for which the information is to be re-used are: (a) to help improve the mapping of Rights of Way in OpenStreetMap, and (b) to convert the datasets to a more convenient format, and then make them available for others to re-use under an open licence.

Secondly, I'd like to ask for some clarification on the data. I understand that you have relatively few Right of Way recorded on your Definitive Map and Statement, but that many others that are likely to be Rights of Way are also included in the GIS data. Assuming the format is the same as the previous version on rowmaps.com, would I be right in assuming that the GIS features with an entry in the DEFMAPNO field are the routes that appear on the Definitive Map, while the others do not? What is the significance of the latter prefix in the DEFMAPNO field? Does B=Birmingham, SC=Sutton Coldfield perhaps, and what to the other letter combinations (BM, CH, FK, FR, H, M, NA, WY) represent?

Many thanks for your reply to my FOI/EIR request, and for providing a copy of the data requested. However, it seems that you have not responded to my request for permission to re-use the information supplied. I asked:

You provided me with the requested in formation on 10th December. However, as far as I can see, you failed to respond to my re-use request made under the Re-Use of Public Sector Information Regulations. I replied asking you to confirm that this part of the request was still under consideration. (At the time you were still within the permitted 20 working days.) However, I never received a response.

I apologise that it has been so long since my original request, but I've only just noticed that I never received a response from you on the re-use request. Could you please look into this, and provide an appropriate response? For you convenience, the re-use request for the supplied Public Rights of Way GIS data was as follows:

Many thanks for your response; I'm happy that you have agreed to the re-use of the information.

However, I specifically asked to be able to re-use the information under the Open Government Licence v3 at https://www.nationalarchives.gov.uk/doc/... , but your reply does not explicitly mention this. The precise licence is very important for my intended use of the information.

So could you confirm that the information can be re-used under this licence without any additional requirements? Also, do you have a specific attribution statement that you wish to provide for use with it?
