Dear Cheshire Constabulary,
Please treat this email as a request for information under the Environmental Information Regulations 2004, alternatively the Freedom of Information Act 2000.
Please confirm if Cheshire Police have made a decision that Cheshire Hounds Hunt is exempt from S.11.1 of the Public Order Act with its bi/tri weekly processions on public roads.Please advise what that decision was.
If the decision was that the Cheshire Hounds Hunt is not exempt from S11.1 then:
Has Cheshire Constabulary made a decision that the regular Cheshire Hounds Hunt processions fall within the ambit of S11.2 as “common or customary” processions?

REQUEST
1. Please confirm if Cheshire Police have made a decision that
Cheshire Hounds Hunt is exempt from S.11.1 of the Public Order Act with

RESPONSE
No information held.
Please note that the Freedom of Information Act relates to recorded
information held by the public authority at the time of the request. The
Act does not cover information that is in someone’s head and a public
authority does not have to create new information or find the answer to a
question from staff who may happen to know it.
I am aware that you have made a number of Freedom of Information requests
over the last few months. A number of these relate to information that is
not recorded by Cheshire Constabulary. I have spoken to Superintendent
Westgate who has advised she is willing to speak to you to try to assist
you with some of the questions you have in relation to hunting. If this is
something you would be interested in please provide us with a contact
telephone number and I will then pass this to Superintendent Westgate to
make contact with you.
If you are not satisfied with the decision applied in this case I enclose
for your attention a copy of the Constabulary's appeal procedures.
