Dear Judicial Conduct Investigations Office,

I would like to know the number of UK judges in the last six months who made a ruling and conviction at Crown Court trials who were not under either thier Judicial Oath or thier Public Oath?

Thank you for your reply but you have not answered the questions.
My question was:
Has more than 1 (one) UK judge in the last six months, made a convict ion at Cr own Court trials who were not under their Judicial Oath and/or their Public Oath?

Your answer was:
I can confirm that Judges have sat before taking their Oath. As mentioned in our previous response, Judges who sit in the Crown Court (i.e. High Court Judges, Circuit Judges and Recorders) are required to take the Judicial Oath ‘as soon as maybe after accepting office’ (see sections 10(4) Senior Courts Act 1981, 22 Courts Act 1971 and the Promissory Oaths Act 1868). Therefore, there is no prohibition on them hearing cases after they have been appointed but prior to theirformalswearing-in ceremony.

I have not asked what the high court shall consist of (sec 10(4) Senior Courts Act 1981) Or who shall take an oath, Courts Act 1971, Promissory Oaths Act 1868. I asked has more than 1(one) judge in the last six months made a conviction, at Crown Court trials who were not under thier judicial Oath and/or Public Oath. For clarity how many Judges who have been sworn in and have accepted thier office have then sat and ruled and convicted at crown court while not under oath either Judicial or Public, while acting as a judge.

There has not been any UK judges in the last six months who have sat as judge in a crown court who then rulled and past judgment including sentancing of incarceration who was not under their Public and Judicial oath.?
