I think you wanted the underwriter and policy number. Not so long ago, shops and other business establishments would have these details on their walls for the customers to see. Why has this changed? You can also report them if they don't provide the details to the regulators.

Subject: 'Self-Insurance' fund/ Public Liability Insurance

 

Thank you for your request for information of 09/01/2018, which has been
processed under the terms of the Freedom of Information (Scotland) Act
2002. Unfortunately, the Council is only able to meet part of your
request; this information is released to you now. I shall address each of
your questions in turn.

 

You asked the following:

 

Q1. Does your local authority keep a 'Self-Insurance' fund in relation to
claims made against the Local Authority?

 

A1. Yes.

 

Q2. If your local authority does keep a 'Self-Insurance' fund, that is the
financial value of the fund?

 

A2. Funds are reserved to meet public liability claims amount to £3.8M.

 

Q3. Who is the local authority's current (as of 01/01/2018) Public
Liability Insurance provider?

 

A3. QBE Insurance (Europe) Limited.

 

Q4. How much does the current public liability insurance pay on a per-case
basis?

 

A4. The value of the claim less a £150,000 excess, up to the limit of
indemnity of £50,000,000.

 

Q5. What is the total public liability insurance value? (how much will the
policy pay out in total?).

 

A5. The limit of indemnity is £50,000,000 per occurrence.

 

Q6. How much is the current public liability insurance annual premium?

 

A6. The annual premium amount shall not be provided. Under the terms of
the Act, a request for information can be refused where one or more
exemptions listed in the legislation apply. In this instance, the Council
is applying the following exemption to the information that you have
requested: Section 33(1)(b) - Commercial interests and the economy.

 

This exemption applies when its disclosure under the act would, or would
likely to, prejudice substantially the commercial interests of any person
(including without prejudice to that generality, a Scottish public
authority). The Council considers that if this information was disclosed
to you it would harm the insurance provider’s commercial interests by
providing external insurers with an unfair advantage when competing for
Council contracts and work.

 

I am also required to consider the application of the public interest test
in section 2(1)(b). In doing so the Council appreciates the public
interest in ensuring that it receives value for money and is transparent
and accountable in how it spends public funds. However, if the Council
were to release this information into the public domain, it would cause
substantial harm to both the Council seeking to obtain the best value for
the citizens of Edinburgh and the insurance supplier. The Council
therefore finds that the public interest in providing this information is
outweighed by the Council’s need to maintain confidentiality on costs in
line with the need to provide best value for money and ensuring fair, open
and transparent competition.

 

Please note that this letter constitutes a formal refusal notice under
section 16 of the Freedom of Information (Scotland) Act 2002.
