Our response is as follows:

 

Can you please provide me with an organisational structure chart for
commissioning and public health directorates, that includes the names and
job titles for the following positions:

Please can this include and cover all aspects of operational, strategic
and commissioning specialisms.

 

We have withheld the information relating to the names of junior staff,
i.e. those who are not of Director or Assistant Director level. This
information has been withheld in accordance with section 40(2) of the Act.

Section 40(2) of the FOI A specifies that the personal information of a
third party must not be disclosed if to do so would contravene any of the
data protection principles. This first principle of the Data Protection
Act 1998 (‘the DPA’) states that personal data must be processed fairly
and lawfully.

Personal data is defined under section 1(1) of the DPA as data which
relates to a living individual who can be identified from that data, or
from that data and other information which is in the possession of the
data controller or is likely to come into the possession of the data
controller.

The withheld information comprises the names of junior members of staff,
i.e. those who are not senior members of staff, such as Directors and
Assistant Directors.

The information you have requested relate to living individuals who may be
identified from that data and therefore constitutes personal data.

 

The first principle of the DPA states that personal data must be processed
fairly and lawfully. In considering whether it would be unfair to provide
the requested information (names, email addresses and direct telephone
numbers) and whether this would contravene the requirements of the first
data protection principle, we have considered the following:-

 

Reasonable expectations

 

We have released the details for senior members of staff only and not of
Heads of Service. Junior members of staff are not in public facing roles
or employed at a senior grade, neither do they play an active role in
making decisions affecting the Council. These staff members are not senior
public figures and do not hold an elected office. The Council does not
routinely publish the names of such individuals. It is on this basis that
junior members of staff would have a reasonable expectation that their
identities would remain private and not be disclosed to the public under
the FOIA.
