Dear Greater Manchester Police and Crime Commissioner,

My request for information falls within the context of extreme energy extraction such as is the case in Barton Moss. Extreme technology operations are being, and continue to be, forced upon communities in the Greater Manchester area. Community protest is costly as shown in Balcombe, Sussex, where police protection of extreme fossil fuel companies totalled some £3 million and was funded by the taxpayer.

Question 1: Are Greater Manchester police services to fossil fuel companies tax-payer funded?

Question 2: What provisions are in place to allow officers to refuse deployment in the service of protecting extreme fossil fuel company property? Can you give assurances that for such officers there will not be any negative consequences to such a request.

Question 3: Please supply your policy document showing arrangements for payment of police services rendered to major public events organisers such as football stadia.

I refer to your request for an internal review of the decision of the Office of the Police and Crime Commissioner for Greater Manchester sent to you by email on the 28 November 2013 in accordance with section 1 (1) (a) of the Freedom of Information Act 2000, refusing your request for disclosure of information on the grounds that the information you requested is not held by the Office of the Police and Crime Commissioner.

This review has been carried out by Nigel Battersby, Solicitor, Office of the Police and Crime Commissioner for Greater Manchester.

You request a review of the response provided to Question 2 of your original submission, namely," What provisions are in place to allow officers to refuse deployment in the service of protecting extreme fossil fuel company property? Can you give assurances that for such officers there will not be any negative consequences to such a request".

You consider that you have not been given a reason for refusal and that deployment policy is surely a widely known factor so that unavailability of information could not possibly obtain.

The original response provided to your request was that "the Office of the Police and Crime Commissioner for Greater Manchester does not hold specific information with regards to your request".

It was recommended that you direct your request to the Freedom of Information Team at Greater Manchester Police and as you experienced difficulty using the email link provided, on 4 February 2014 your request was forwarded on to that team by the Office of the Police and Crime Commissioner for Greater Manchester. On 28 February 2014 you received a response from the Greater Manchester Police Information Services Branch informing you that "no information was held" in response to your question 2.

I have carried out an internal review of the information that was provided to you by the Office of the Police and Crime Commissioner for Greater Manchester on 28 November 2013.

Your request was refused on the basis that the information was not held by the Office of the Police and Crime Commissioner for Greater Manchester and confirmation that the information was not held was communicated to you for the purposes of section 1 (1) (a) of the Freedom of Information Act 2000. The Office of the Police and Crime Commissioner did not otherwise seek to rely on an exemption from disclosure for the purposes of section 17 of the Freedom of Information Act.

I am satisfied that the Office of the Police and Crime Commissioner provided you with reasonable advice and assistance to satisfy the duty under section 16 of the Act by transferring your request to the Greater Manchester Police Freedom of Information Team.

In the circumstances, your request for an internal review of the decision is not upheld on the grounds that the information you require is not held by the Office of the Police and Crime Commissioner for Greater Manchester and this has been confirmed to you in accordance with section 1 (1) (a) of the Freedom of Information Act 2000. Unfortunately the Office of the Police and Crime Commissioner is unable to disclose information to you that it does not already hold.
