Protected Earnings Rate on non-priority attachment of earnings orders

We're waiting for J Lloyd to read a recent response and update the status.

Dear Her Majesty's Courts and Tribunals Service,

Please can you provide the methodology used to assume the Protected Earnings Rate and what data/research was used to back up the formula with 'having regard to the debtor’s resources and needs' and

whether an individuals particular rent/mortgage is taken into consideration and or if not then on what basis is it presumed that it has taken regard to the debtor’s resources and needs

whether an individuals particular credit commitments are taken into consideration? and or if not then on what basis is it presumed that it has taken regard to the debtor’s resources and needs

whether an individuals area and cost of living (which fluctuates greatly dependant on the area) are taken into consideration? and or if not then on what basis is it presumed that it has taken regard to the debtor’s resources and needs
