Dear Crown Prosecution Service,

In the context of a penalty ticket offence, a non endorsable one, it says on your Guidance, as well as the Home Office's, that a prosecution should not occur unless the offender request a hearing. It further states that if a ticket is issued and not paid, it should be registered as a fine, as to a prosecution taking place.

If there was just one penalty ticket offence in question, and no penalty ticket has been issued, does this mean that the prosecution test is not applicable in regards to weighing up the evidence and public interest?
