Dear Crown Prosecution Service,

Given that the FGM Act 2003 provides that:

(2)But no offence is committed by an approved person who performs—
(b)a surgical operation on a girl who is in any stage of labour, or has just given birth, for purposes connected with the labour or birth.

Did the CPS consider whether Dr Dharmasena would have a valid defence under this part of the act? What was the CPSs reasoning for believing that Dr Dharmasena's actions were not covered by this part of the act?

I believe there is a strong public interest in providing this information given the allegations in the press that this prosecution was brought for "political" reasons.
