Proposals to ban dogs from public spaces in Nottingham - evidence given to Nottinghamshire City Coucil by police, please.

Nottinghamshire Police did not have the information requested.

Dear Nottinghamshire Police,

An article in the Nottingham Post of 17th May 2016 claimed that, the City Council was meeting that evening, to consider banning dogs from open spaces in the City.

The story in the Nottingham Post featured a statement from a Council spokesperson who claimed - among other things - that the council had " reports of dogs causing considerable alarm and distress to park/public open space users and pedestrians generally."

I wrote to them under the FOIA, requesting that they provide the information they claim to have.

They have refused my request for evidence of "dogs causing considerable alarm and distress to park/public open space users and pedestrians generally, because they claim that the POLICE have it and they have asked to me to make a separate enquiry to you for that information.

In their response, the Council said, "In addition, a number of reports of dogs causing considerable alarm and distress to park users were identified through our partnership working with the police and obtained through police computer systems. This information is for the police to share and therefore cannot be disclosed in accordance with Section 1 of the Act as it is not held by the Council.

As we are directing you to our offices where you can find the information you require, please accept this letter as a partial refusal notice issued under Section 17, as we have relied on Section 21 of the Act. "

Therefore, under the Freedom of Information Act, I am therefore writing to request the following:

Please provide (anonymised) copies of all reports you have of " dogs causing considerable alarm and distress to park users" submitted to the Council (on 17th May or before), which provided the evidence they claim to have considered during their debate on 17th May. Can you please send me the report or the anonymised accounts you received from people who made reports to you of 'dogs causing considerable alarm and distress to park/public open space users and pedestrians generally.'

Dear Freedom of Information,

I thank you for your response to my enquiry, but it is clear that you have not properly read the Request. Since your response to this Request was late, I can only surmise that your response was hastily thrown together and that you couldn't be bothered to deal with the Request properly.

Nottingham City Council held a meeting on 17th May, to discuss Public Space Protection Orders in the City area, to deal with problems they claim were caused by dogs and their owners. They claim that the decisions taken that evening were based - in part - on evidence submitted to the meeting by Nottinghamshire Police.

Therefore, whatever work was required to put this information together must already have been done, prior to the meeting of Nottingham City Council on 17th May. Otherwise, Nottinghamshire Police could not have submitted it to the Council, as stipulated in their Minutes and in several communications (and a meeting) that I have had with their Chief Enforcement Officer.

I am requesting a copy of that information, please, as submitted to the City Council for their consideration, but annotated to protect identities where appropriate.

Please look again at this request. Unless you are going to claim that Nottingham City Council has lied, then the information must be readily available to you.
