I made the following freedom of information request to Stockton Borough Council, and they told me to contact you for the information.

The Local Government Office reports that Local Councils are sitting on 23,000 vacant residential properties.

I would like to know how many vacant council-owned properties does Stockton Borough Council hold at this current time?

I would also like to know how many council owned properties do SBC hold at the current time please, with a breakdown of type of property, and number of bedrooms, so for example:

x amount of 1 bedroom flats,
x amount of 2 bedroom flats,

etc.

I would like to ask you similar questions, but relating to the Thirteen Group.

1. How many properties do the Thirteen Group own in the Stockton Borough Council area at the present time?

Can you give me a breakdown of the type of properties and number of bedrooms, for example:

2. How many unoccupied properties are there in the SBC area, that have been vacant/unoccupied for a period of more than 28 calendar days.

3. Can I have a list of property types and amount of bedrooms that are unoccupied, why they are unoccupied, how long they have been unoccupied, and when they are expected to be reoccupied. This question relates to properties that have been unoccupied for 28 calendar days or more.

Thank you for your email, however, your enquiry relates to properties
owned by SBC, we do not have records about properties held by them.  Also,
we are not bound by the Freedom of Information Act due to the landlords
being registered charities and we are not a public body.

Thank you for your reply. According to the information I have copied below, although you are not strictly subject to the FOI act, the Housing Corporation state that we can write to housing associations.

This Housing Association is not strictly subject to the Freedom of Information Act but according to the Housing Corporation: "You can also write to housing associations. Most try to be as open as possible and will provide you with information when they are able. My original enquiry relates to The Thirteen Group, and how many properties The Thirteen Group own in the Stockton On Tees borough council area. Stockton Borough Council told me that that Stockton Borough Council undertook a stock transfer during December 2010 to Tristar Homes Limited (part of the Thirteen Group) and no longer owns any housing stock.

I would like an answer to my question, if possible please. I've relisted the original questions below.

I am writing to request an internal review of Thirteen Group's handling of my FOI request 'Properties in Stockton On Tees Borough.'.

I contacted Stockton On Tees Borough Council (SBC) and asked them about houses in the SBC area. They told me that The Thirteen Group (TTG) deal with all the properties since they were transferred across, and that they, TTG could answer my questions.

After my initial question, I was told that it was SBC that I needed to speak to, but it's not, I've checked, it is TTG.

I have waited for in excess of a month since my last contact, and have heard nothing. I was told by TTG person handling this that they don't have to reply, but as I informed them - "Thirteen was created in April 2014 from the merger of two North East housing groups, Fabrick and Vela. I have discovered that my tenancy number is actually a Citibank account number. I would like to find out how our housing stock was sold off to these Housing corporations and how they were paid for. The housing stock is a trust held for our benefit yet somehow we are now the surety or trustees where the councils were the trustees and we the beneficiaries. Now, these property corporations are the beneficiaries of our trusts and not us. This would be highly unlawful.

I have now found some very interesting evidence of serious fraud. We have the "Association" and the "Management Agencies". The Association is a trust and held all housing stock, while the Management Agencies were contracted to manage said trust stock and initially presented themselves as charities to the public but never were, according to a S.A.R that I made. I am still obtaining certain evidence with this issue too. They have now converted to Societies under the Co-operative and Communities Benefit Act 2014 by special resolution. I will be going to court with this next month and will be inviting many interested parties to observe. I will also be filing charges with Action Fraud.

I have reviewed the processing of your FOI request and apologise for the
delay in responding. 

 

Your initial request asked for information relating to properties owned by
Stockton Borough Council and Janice McNay, Thirteen’s Compliance Leader,
responded by advising that we did not hold this information.  She also
advised that as the landlords of Thirteen Group were not public bodies and
three had charitable status, we were not subject to the requirements of
the Act.  We do aim to be transparent and, where possible, will provide
information requested, however where the request would require a great
deal of resource and specific activity, this cannot always be justified.

 

It is for this reason we did not provide the information you requested, as
we would need to devote specific and significant resources to this task
and our priority at this time is to deliver services to, and ensure the
health and safety of, our customers and ensure properties are relet as
soon as possible.
