Thank you for your request for information about the above. Your request
was received on 28/4/2016 and I am dealing with it under the terms of the
Freedom of Information Act 2000.

We always aim to respond as quickly as possible, and in this case will do
so no later than 27/05/2016, which is the 20 working day deadline. The

In some circumstances a fee may be payable and if that is the case, I will
let you know. A fees notice will be issued to you, and you will be
required to pay before we proceed in dealing with your request.

Freedom of Information, East Sussex County Council

Dear Mr Hedger

FOI Request ref:  7102 / Properties for sale

Thank you for your request for information about the above, which has been
dealt with under the terms of the Freedom of Information Act 2000. Your
request and our response are set out below. Please note that any
information we provide is subject to the copyright and reuse of
information terms and conditions set out at the bottom of this email.

REQUEST

1. a list of council owned properties in East Sussex which will be on the
market 2016/7 2.

2. details of how to receive alerts on these properties when they are
marketed

3. an outline of the procedures used to ensure that all potential buyers
receive equitable treatment in terms of opportunity to bid?

RESPONSE

1. It is not possible to determine precisely all properties that will be
placed on the market in a specific time period. This information is
therefore not held

2. Properties which are placed on the open market will be placed on our
website
[1]https://new.eastsussex.gov.uk/yourcounci... .
We do not provide alerts so all we can advise is that you regularly check
the website.  If you have a specific interest in a property initial
contact can be made through our team mailbox
[2][email address]

3. Information not held. The Council do not have a written procedure.
However, we do ensure that all parties are given an opportunity to bid as
under s.123 of the Local Government Act 1972 the Council has an obligation
to obtain the best consideration in its disposals.  A common method is for
ESCC to market a property via an agent, this way all members of the public
have an equal opportunity to register their interest or place an offer
with the agent if they so wish.  These offers are then carefully
considered before a decision is made on which offer to accept.   In
certain circumstances the Council will sell a property or piece of land
without openly marketing but this will usually be limited to instances
where the Council has a legal obligation to offer it to a specific
individual or where a property is clearly going to have one purchaser who
above all other likely parties would be willing to pay more.

I hope that this answers your enquiry. If you believe that the County
Council has not complied with the FOI Act in responding to your request,
you may ask for an internal review. If you wish to do so, please set out
the grounds of your appeal in writing to:

Philip Baker, Assistant Chief Executive, East Sussex County Council,
County Hall, St Anne’s Crescent, Lewes, East Sussex. BN7 1UE.

or by email to him at [3][email address]

Please quote the FOI reference number in any communication regarding this
particular request.

If you are not content with the outcome of the internal review, you then
have the right to apply directly to the Information Commissioner for a
decision. Generally, the Information Commissioner cannot make a decision
unless you have exhausted the County Council’s internal review procedure
as described in the previous paragraph. The Commissioner can be contacted
at: Information Commissioner's Office, Wycliffe House, Water Lane,
Wilmslow, Cheshire, SK9 5AF. Tel: 0303 123 1113.  [4]www.ico.org.uk
