Properties acquired via adverse possession by UK and Foreign companies

We're waiting for Wesley Hall to read recent responses and update the status.

Dear Land Registry,

Please provide me with a list of all land title numbers registered to UK and Foreign companies that have been acquired via adverse possession, along with the registered proprietor(s). I require no personal information that will breach data protection legislation. Anything deemed personal should be redacted to comply with the legislation please. 


I understand that you have this information already prepared, as it was previously released to other FOI requests and Private Eye.


If they are within the cost limit, I would also like, for each title (and in priority order):


1. The Town/Village/City, District and Administrative County of the property.
2. Date of registration.

3. Whether the land was previously registered / un-registered prior to the adverse possession.
4. Any sale prices/dates of these properties since the date of adverse possession.

A spreadsheet would be preferable in .xls format.

I refer to my email dated 04 November 2019 acknowledging receipt of your
Freedom of Information request in which I advised you that a response will
be made to your request within 20 working days with a target date being 02
December 2019.

Dear Mr Hall,

Thank you for your email of 04 November 2019 where you requested
information about land title numbers registered to UK and Foreign
companies that have been acquired via adverse possession. along with the
registered proprietor(s). I apologise for the delay in our response. Your
request was dealt with under the terms of the Freedom of Information Act
2000.

Reference to registered UK and Foreign companies has been construed as
those likely to be companies registered at Companies House, A copy of the
information you requested which can be disclosed has been attached to this
email. No time period had been stated in your request but we have treated
this to be from the earliest results HM Land Registry holds which is May
2002. The title numbers that you requested is exempt under section
31(1)(a) of the Freedom of Information Act 2000.

Section 31(1)(a) states

 

“Information which is not exempt information by virtue of section 30 is
exempt information if its disclosure under this Act would, or would be
likely to, prejudice –

 a. The prevention or detection of crime…”

 

It is considered that the disclosure of the information could make the
properties or the proprietors vulnerable to fraud and therefore would be
likely to prejudice the prevention of crime.

 

Section 31 is a qualified exemption. We are required to conduct a public
interest test when applying any qualified exemption. This means that after
it has been decided that the exemption is engaged, the public interest in
releasing or withholding the information must be considered. If the public
interest in disclosing the information outweighs the public interest in
withholding it then the exemption does not apply and the information must
be released.

 

We have considered the following in relation to your request:

 

In favour of disclosure:

o We recognise that there is a legitimate public interest in promoting
the accountability and transparency of public authorities

 

In favour of maintaining the exemption:

o The information requested, especially when combined with other
available information, could be used to build a picture of HM Land
Registry’s land register which would make HM Land Registry and the
proprietors more vulnerable to crime

 

Having considered the public interest, the Department’s decision is
therefore to withhold the title numbers.

 

Please note the data provided has been collected from a variety of sources
as part of the land registration process. Whilst we make every effort to
ensure that the data we provide is as accurate as possible we cannot
guarantee it is fit for your intended purpose or use.

 

The data is also subject to Crown copyright. You may use the data for
personal use/research but this does not entitle you to reuse it for any
other purpose (including commercial use, marketing or publication). If you
wish to reuse the information, please let us know what your intended use
is, so we can consider this further.

 

You should also be aware that third parties may have intellectual property
rights (IPR) in the data. For example, Ordnance Survey and Royal Mail
claim IPR in address data and you should also contact them, if you intend
to reuse the data.
