I refer to an article in local media in which Ingleby Barwick Town Council refused to fly the Pride flag as it could "set a precedent".

Does the town council have a legal requirement to promote Equality?

Do you have any information on what precedent that the council fears would be set? Is it the precedent of supporting equality for those who have characteristics that are protected under the equality act?

Please can you provide information about what the town council has done to promote equality over the last 24 months in relation to each of the nine protected characteristics covered by the equality act.

Please can you advise what training has been provided to councillors on equality, and whether all councillors have completed this training - please provide details of those who have not.

Dear Ms Ritter

Thank you for your request. I will endeavour to answer your questions in the order presented.

The Town Council has a legal duty to consider the needs of all individuals in their day to day work - in shaping policy and delivering services as well as in relation to its employees.

The Town Council, in making its decision felt that it could be approached by other organisations to fly a flag, which in turn would not be physically or administratively viable for the Town Council to adhere to - there is one full time member of staff and one officer who works 12 hours a week. The Town Council are in full support of Pride, there is no suggestion that the precedent was regarding supporting equality for those who have characteristics that are protected under the Equality Act.

There is no explicit requirement to refer to the Equality Duty in recording the process of consideration. The Town Councillors receive an induction once elected and are required to adhere to the Members Model Code of Conduct for Local Government in decision making. I can confirm that all members have received this and signed the declaration of office.
