Dear Home Office,

I read with interest your very recent response to a request for information in relation to Promissory Notes.

Within your Disclosure, you Stated that: "We (Home Office) can [and do] accept payment by Promissory Notes". You candidly go on to elaborate that The Home Office currently accepts Promissory Notes only for The Ministry of Justice.

It is not clear whether you mean that The Home Office accepts payment for The Ministry of Justice in that sense that you accept Promissory Notes FROM The MoJ and no-one else or whether you mean that The Home Office accept payments FOR (on behalf or as agent etc) The MoJ only. (You do say that The Home Office will accept promissory notes from others on a "case-by-case basis").

Please clarify your earlier Disclosure.

Re: Promissory Notes from the Ministry of Justice and my Freedom of Information Act Request about the same.

Thank you for your prompt and clear reply confirming the meaning of your response to an earlier Request by another person.

You confirm that The Home Office (as creditor) accepts from The Ministry of Justice (as debtor) Promissory Notes and that The Home Office does and will accept from others, payments by Promissory Notes (on a case by case basis) subject to the provisions of an agreement in force prior to the issue / acceptance of any Promissory Note. [The Home Office is not obliged to enter a contract to accept Promissory Notes.]

The Home Office (as all creditors) (in England and Wales) are not obliged to accept Promissory Notes unless an agreement is in force first (which, as the Courts have Ruled on numerous occasions is the correct position in Law).
