FOI England (NHS ENGLAND), NHS England

Dear Mr Taylor

Re:      Freedom of Information request (Our Ref: FOI-017968)

Thank you for your Freedom of Information (FOI) request dated 15 September
2016.

Your exact request was:-

‘Would you please release the Price Waterhouse Coopers Capacity and
Capability Review into Cambridgeshire and Peterborough Clinical
Commissioning Group.

The report I am referring to has also been described as a "Governance and
Finance Capacity and Capability Review" and the Clinical Commissioning
Group Governing Body was told in July 2016* that the review was complete
and publication was awaited.

*Paragraph 3.2 at

NHS England holds information related to your request. However, we
consider that this information is exempt under Section 43(2) of the FOI
Act. Section 43(2) exempts from the general duty to release information
which would, or would be likely to, prejudice the commercial interests of
any entity, including the public authority holding the information.

Section 43(2) is a prejudice based exemption and, as such, we are required
to assess both the prejudice test and the public interest test in
withholding this information against that of its release.

When assessing the prejudice test, NHS England need to demonstrate that
there would be an impact on the commercial interests of NHS England or
upon a third party should this information be released.

We believe that releasing this information would prejudice the commercial
interest of Cambridgeshire and Peterborough Clinical Commissioning Group
(CCG). The information requested contains an in-depth review of financial
probity and other financial details which could jeopardise the CCGs
ability to negotiate commercial contracts for the NHS.

NHS England is also required to conduct the public interest test, which
assesses whether releasing the information would be in the public interest
despite the prejudice test being satisfied. It is important to bear in
mind that any disclosure under the FOI Act is a disclosure to the public
at large and not just to the applicant. NHS England has considered making
this document public, recognising the public interest in the transparency
and accountability of its service provision. However, we have concluded
that the harm to the organisations i.e. the CCG and NHS England, will
outweigh the public interest in publishing the document. Releasing this
document will affect future procurement processes and also provision of
robust and cost effective services.

NHS England considers that some of this information is also exempt under
section 40(2) (personal information) of the FOI Act, as the information
constitutes third party data. Section 40(2) provides that personal data
about third parties is exempt information if one of the conditions set out
in section 40(3) is satisfied. Under the FOI Act disclosure of this
information would breach the fair processing principle contained in the
Data Protection Act (DPA), where it would be unfair to that person/is
confidential.  Section 40(2) is an absolute exemption and therefore not
subject to the public interest test when considering disclosure of
information.

There are no plans to publish this document in any form.
