[potentially defamatory material removed] landlords

Dear Haringey Borough Council,

Following an article in the Guardian today about [potentially defamatory material removed] landlords I wish to make a request for FOI information.

I wish to know the following:

1. Is the Council making any housing benefit payments to any of the landlords on the [potentially defamatory material removed]:

Buryfield Ltd
Istvan Bacs
Michael McGarvey

As these names are on the public database there are no GDPR issues with this request as I am not asking you to identify the individual properties. You can check the public register to make the checks to identify the landlord.

2. If the answer to Q1 is yes, please break this down by [potentially defamatory material removed] landlord, number of claims in payment and amount paid by individual claim in 2017-18 financial year.

3. Is the council making any housing benefit payment to [potentially defamatory material removed] landlords listed on the restricted part of the database - you will have access as the Council.

4. If the answer to Q3 is yes, please break this down by [potentially defamatory material removed] landlord, number of claims in payment and amount paid by individual claim in 2017-18 financial year.

5. Has the council used any of the [potentially defamatory material removed] landlords on the public register r for homeless people? For the purpose of homeless housing or permanent housing.

6. Has the council used any of the landlords on the restricted part of the database for homeless families? For the purpose of homeless housing or permanent housing

7. If the answer to Q5 or 6 is yes, please tell me which landlords have been used, how many of their properties have been used and whether the [potentially defamatory material removed] landlords got any money. If they got money please tell me how much.

8. Please provide copies of the procedure checks the council uses to check that Haringey landlords are fit landlords before homeless people are put in there.

9. Please provide copies of the procedure checks the council used to check that landlords outside Haringey are fit landlords as the newspaper said that houses can be used for homeless people outside Haringey.

We can confirm that housing benefit entitlement are paid on behalf of the tenants living in the accommodation managed by Buryfield Ltd and

Michael McGarvey. There is no trace of any housing benefit payment credited to Istvan Bacs.

2. If the answer to Q1 is yes, please break this down by [potentially defamatory material removed] landlord, number of claims in payment and amount paid by individual claim in 2017-18 financial year.

Buryfield – Two claims paid. £ 11,933.05 and £9,600.00

McGarvey – Three claims paid £11,219.13, £7,893.06 and £9,984.00

3. Is the council making any housing benefit payment to [potentially defamatory material removed] landlords listed on the restricted part of the database - you will have access as the Council.

We only have access to the same database as the public. We currently do not have a privileged access as suggested and therefore not in a position to respond to this particular query.

4. If the answer to Q3 is yes, please break this down by [potentially defamatory material removed] landlord, number of claims in payment and amount paid by individual claim in 2017-18 financial year.

This is not applicable as the answer to question three is No.

5. Has the council used any of the [potentially defamatory material removed] landlords on the public register for homeless people? For the purpose of homeless housing or permanent housing.

No, it would appear that the tenants in these units have made their own arrangements in the Private Rented Sector.

6. Has the council used any of the landlords on the restricted part of the database for homeless families? For the purpose of homeless housing or permanent housing

As the Council do not have access to the restricted part of the database, we are unable to respond to this particular query.

7. If the answer to Q5 or 6 is yes, please tell me which landlords have been used, how many of their properties have been used and whether the [potentially defamatory material removed] landlords got any money. If they got money please tell me how much.

The response to questions 5 and 6 are negative.

8. Please provide copies of the procedure checks the council uses to check that Haringey landlords are fit landlords before homeless people are put in there.

We have a self-declaration form completed by all property owners and in addition, a search is initiated locally with the Council’s Environmental Health Colleagues and the Mayors’ Database register to ascertain the landlord’s status. I have attached a copy of the self –declaration form for your attention.

9. Please provide copies of the procedure checks the council used to check that landlords outside Haringey are fit landlords as the newspaper said that houses can be used for homeless people outside Haringey.

We have a self-declaration form completed by all landlords in/out of borough. In addition to this form, a search is initiated locally with the Council’s Environmental Health Colleagues and the Mayors’ Database register to ascertain the landlord’s status.
