Political infrastructure GDPR

The request was refused by Bristol City Council.

Dear Bristol City Council,

Please can you confirm that data on political opponents held by mayor Marvin Rees, Asher Craig, Craig Cheney and Kevin slocombe on political opponents is held on their personal electronic devices and not the council system, and thus not subject to GDPR?

This data includes screenshots and information over the last 3 years used occasionally to attack whistleblowers or those questioning the authority or actions of the council.

Thank you for your email dated 4 March 2019.

Your request as it currently reads does not constitute a valid
Freedom of Information (FOI) request under the FOI Act 2000.

The FOI Act gives a general right of access to all types of recorded
information held by public authorities when the request is made. For
example, an FOI request would be for a copy of a policy, rather than
an explanation as to why we have that policy in place. The FOI Act
does not require public authorities to create new information or give
an opinion if this is not information that is held.

In order to respond to your request, we would need clarification on
what you mean by "political opponents" and what recorded information
you’re seeking that may be held by Bristol City Council or by the
Mayor, Deputy Mayors or Councillors that relates to official Council
business.

Until we receive clarification, the Council will consider this

Having reviewed your request, the time required to collate the
information requested will exceed the 18-hour threshold so we are not
able to fulfil your request without further refinement.

 

It is not possible to run a search for screenshots of Facebook and
Twitter specifically, so this search would require the manual
reviewing of every image file stored on the computers of the Mayor,
Cllr Asher Craig and Kevin Slocombe in any form (on local drives,
email servers, etc.) for the past three years.

 

We are not able to provide advice on how to narrow your search as it
is not clear what data you are looking for.
