Dear Staffordshire Police,

I would like you to confirm how the Service indemnifies vehicles against third party risks, either by placing a bond or purchasing an insurance policy. Please also confirm if these vehicles are registered on the MID and how these are maintained (be it by insurance company, list submitted to court)

- If this is by bond, who holds the financial asset, what is the value of this bond, and how many vehicles does this cover (with a breakdown of car, van, truck etc.).

- If this is by insurance, please provide a copy of the certificate of insurance and appropriate policy information, confirm how much this insurance costs, who the underwriter is, how many vehicles this covers and when the policy is up for renewal. Finally, please confirm how the Service tenders out its vehicle insurance requirements.

I am writing to request an internal review of Staffordshire Police's handling of my FOI request 'Police vehicle insurance / third party risks'. Please disregard any aspect of the section 40(2) - personal information exclusion, as I accept this. I do not accept any section 43 - commercial interest argument.
I am writing to request an internal review of West Midlands Police's handling of my FOI request 'Police vehicle insurance / third party risks'. This is with particular focus on the public interest test, which I think has overlooked some important points in favour of disclosure.

The Section that applied has not followed the ICO guidance handling by seeking further advice from the commercial entity involved. Equally, there is a public interest to ensure that taxpayer money is being spent effectively. You make the point that it would disadvantage the Company tendering the contract, however it could encourage companies to be more competitive when they know what other companies' are offering. This would ensure that the Service accesses the most competitive offers.

You have cited the likelihood of prejudice to a third party's commercial interests. As you may be aware, ICO guidance states "When a public authority wants to withhold information on the basis that to disclose the information would or would be likely to prejudice the commercial interests of a third party, it must have evidence that this does in fact represent the concerns of that third party. It is not sufficient for the public authority to speculate on the prejudice which may be caused to the third party by the disclosure."

You have cited the likelihood of prejudice to a third party's concerns, but you have not consulted this third party. As you may be aware, ICO guidance states "When a public authority wants to withhold information on the basis that to disclose the information would or would be likely to prejudice the commercial interests of a third party, it must have evidence that this does in fact represent the concerns of that third party. It is not sufficient for the public authority to speculate on the prejudice which may be caused to the third party by the disclosure."

Finally, As you may be aware, ICO guidance on the Section 43 exemption states that: "It is [...] important for a public authority to consider each clause within a contract, rather than view the contract as a whole. Arguments about the burden this may create are not relevant under section 43". (https://ico.org.uk/media/for-organisatio...)

In the light of this, please release all parts of the contract to which Section 43 would not be relevant.

Please review this decision, and, if the exemption is upheld, demonstrate stronger evidence that this disclosure 'would, or would be likely to' prejudice the concerns of the third party.
