Dear University of Huddersfield,

Numerous concerns have been raised by Police Now participants as to the standard of the Police Now Huddersfield Programme (Graduate Diploma for Professional Policing Practice), in addition to the extremely low ranking of Huddersfield as an institution.

In order to ensure transparency and accountability, the following information is requested via foi-

1) The contract(s) between the University of Huddersfield and Police Now relating to the Graduate Diploma for Professional Policing Practice.
2) The number of complaints made by Police Now participants in relation to the Graduate Diploma for Professional Policing Practice or any member of staff.
3) The nature of the complaint(s).
4) The outcome(s) of any subsequent investigation.
5) Any emails sent or received by Jason Roach, Rachel Armitage, or Michelle Rogerson, relating to complaints regarding the Graduate Diploma for Professional Policing Practice or any staff member from 01/05/2019 to 20/09/20
6) The number of students who have withdrawn themselves from the Graduate Diploma for Professional Policing Practice.

Our response to your request for information dated 22 September 2020 is
provided below.

 

o The contract(s) between the University of Huddersfield and Police Now
relating to the Graduate Diploma for Professional Policing Practice.

o The information requested is exempt under section 43(2) of the Freedom
of Information Act 2000 and is therefore being withheld.  The
information is commercially sensitive and the commercial interests of
the University would likely be prejudiced by its disclosure given the
increasingly competitive nature of the HE sector.  Having considered
the public interest, the University's decision is to withhold the
information. 

 

o The number of complaints made by Police Now participants in relation
to the Graduate Diploma for Professional Policing Practice or any
member of staff.
o The nature of the complaint(s).
o The outcome(s) of any subsequent investigation
o Any emails sent or received by Jason Roach, Rachel Armitage, or
Michelle Rogerson, relating to complaints regarding the Graduate
Diploma for Professional Policing Practice  or any staff member from
01/05/2019 to 20/09/20

o Number of complaints made by Police Now participants is ≤5. Because
of the small numbers involved, to provide you with exact number, and
the subsequent details including emails relating to the complaint(s)
could lead to the identification of individuals, which is covered by
the Data Protection Act 2018. Accordingly, this email constitutes a
refusal notice for this element of your request under Section 17(1) of
the Freedom of Information Act and an exemption under Section 40(2) by
virtue of 40(3)(a)(i) of the Act is being applied. Under the Freedom
of Information Act disclosure of these details in full would breach
the fair processing principle contained in the Data Protection Act,
where it would be unfair to individuals.

 

o The number of students who have withdrawn themselves from the Graduate
Diploma for Professional Policing Practice.

o Academic Year 2019/20  – 16

Please note that the University is informed of the withdrawals via Police
Now and therefore the exact reasons for the withdrawals are not known.
Furthermore, students who enroll on the programme but does not start are
also categorised as ‘withdrawal’ and is included in the above number.

Further to your e-mail dated 3 November 2020, requesting an internal
review of our response to your request under Freedom of Information Act
(the “Act”) dated 9 October 2020 please find below the response from the
University of Huddersfield (the “University”).

 

1. Review Process

 

In conducting this internal review I have carefully reviewed your request
and the University’s response, which are summarised below:

 

•             Your initial Freedom of Information request dated 22
September 2020 and our response dated 9 October 2020 (“Response”); and

•             Your e-mail dated 3 November 2020 requesting a review of the
University’s handling of your request.

 

2. Response

 

The University’s response explained that the contract between the
University of Huddersfield and Police Now was exempt from disclosure under
Section 43 (2) of the Act.

 

3. Internal Review

 

Having undertaken a detailed analysis, my review has determined that the
University's response relating to your request for the contract between
the University of Huddersfield and Police Now relating to the Graduate
Diploma for Professional Policing Practice is upheld, and that the
exemption under Section 43 (2) of the Act was correctly applied.

 

In considering the application of the S43 (2) exemption I took into
account the following factors:

 

o whether the release of the information would likely prejudice the
University’s commercial interests and; Yes
o whether the activity was being conducted in a competitive environment
and the extent to which disclosure would likely affect the
University’s ability to participate competitively in the activity; Yes
o whether the contract between the University and Police Now, includes
any clause of confidentiality that would be comprised if the contract
was disclosed. Yes

 

The Graduate Diploma in Professional Policing Practice is a bespoke course
specifically designed for members of Police Now and funded entirely by The
Police Now. The University invests significantly in determining the
viability of new provision and the specific make-up of programmes in areas
such as market research and data analysis to ensure quality provision.
Competing HE institutions could gain a competitive advantage if details
for the contract and the course were available in the public domain which
could negatively impact on the University’s ability to participate
competitively in this element of its portfolio, ultimately leading to a
decline in student numbers and possible course closure.
