We hold the information requested for UK insurers, but we do not hold this
information for EEA insurers. However, we are prohibited from disclosing
the list of UK insurers to you, as it constitutes ‘confidential
information’ for the purposes of section 348 of the Financial Services and
Markets Act 2000 (FSMA), and which the FCA has received in the discharge
of its public functions. We are therefore prohibited from disclosing this
information under section 44 of FOIA. For more information on why this
exemption applies, please see Annex A.

·                Section 44 (Prohibitions on Disclosure)

 

Section 44(1)(a) of FOIA states that information is absolutely exempt from
disclosure if this is prohibited by law.  Section 348 of FSMA restricts
the FCA from disclosing ‘confidential information’ it has received in the
course of carrying out its public function.  FSMA allows exceptions to
this in a few specific circumstances, but none of these apply to this
request.

 

Confidential information here is defined as non-public and non-anonymised
information involving a person’s business or other affairs, which the FCA
received in the course of carrying out its public function.

 

The information you requested is confidential information under this
provision.  If we disclosed this information, without the provider’s
consent or the consent of the person the information is about (if
different), we would be in breach of section 348 of FSMA.  This would be a
criminal offence.

 

In many requests for information under FOIA we have to judge different
factors to decide whether disclosing the requested information would be in
the public interest or not.  For this request, we have an ‘absolute’
exemption against supplying the information, and so we do not need to make
this kind of judgement.

I am writing to request an internal review of The Financial Conduct Authority's handling of my FOI request 'Please supply a list of all general insurance companies currently providing personal a) home insurance, and b) motor insurance in the UK'.

I fail to understand your claim that any of the information I am asking for is "confidential".

As you may be aware, ICO guidance explains that one of the ways to ascertain whether release of information would constitute a breach of confidence is to consider whether it would be actionable in court, and then, whether such an action would be likely to succeed. It says that the authority needs to demonstrate its thinking on this point, which will also involve a version of the public interest test in which you balance the public good of any disclosure against the breach of confidence. ICO guidance also states, "If the requested information is commercial in nature then the disclosure will only constitute a breach of confidence if it would have a detrimental impact on the confider."

Your response also includes:
"Confidential information here is defined as non-public and non-anonymised
information involving a person’s business or other affairs, which the FCA
received in the course of carrying out its public function."

Please explain in what way naming insurance companies which provide motor or home insurance in the UK is "non public" information? Surely no company can provide such insurance in secret? How can it get customers unless it is public information that it offers such insurance?
Please explain the relevance of "non-anonymised" here: I am not asking for names of individuals but names of companies.

Please review your decision, and, if the exemption is upheld/if you still claim the information is confidential, include a demonstration of your assessment of the detrimental impact on any confiders.

In addition, given that you were going to refuse my request, please explain why you didn't respond promptly rather than waiting until the end of the 20 working day limit.

the work undertaken so far has shown that it is likely that to comply with
your request in full would exceed the appropriate limit set by the
Regulations made under section 12 of the FOI Act (The Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004 (“the Regulations”) made by the Ministry of Justice.

 

As the scope of your original request is very broad and to help us deal
with it, within the appropriate cost limit, it would therefore be helpful
if you can please clarify what specific information you require. For
example,

 

 1. Is the scope of your request restricted to insurers – as product
providers of home and motor insurance?
 2. Is the scope of your request restricted to firms based in the United
Kingdom or does it also include firms based overseas (and providing
personal home or motor insurance to UK customers) e.g. Gibraltar or
EEA countries.
