I remind you that under the Freedom of Information legislation Shropshire Council is obligated to provide all recorded information relating to a request unless it falls under an exemption. 

As it is implausible for there to have been no recorded correspondence/information whatsoever between the Council’s Planning and Ecology departments in relation to this planning application (ref: 17/01033/EIA), I would have expected the following information to be included in the Council’s response:

1. Copies of all information that has passed between the Planning and Ecology departments, including any correspondence with any third parties (such as other public bodies, the applicant, or the applicant's agent), regardless of format, location or method of transmission.  I would also expect the response to include, but not be limited to email and auto-generated reminders from the planning system.

2. Copies of formal and informal internal meeting minutes, agendas, pre and post meeting correspondence and meeting papers for meetings where ecology and planning sit on the same meeting and have discussed anything pertaining to this planning application.

Given it has taken over 5 weeks for the Council to respond with none of the information requested, I now expect a response, as Freedom of Information legislation dictates, in a timely manner.

consultee response (re-consultation after the JR) to this planning
application. I can confirm that this is being checked and finalised and
will be published on the Council website by the end of December, as such
Regulation 12(4)(d) of the Environmental Information Regulations apply on
the basis that this is information that is still in the course of
completion and once finalised will be available to you on the website in
the timeframe provided above.

 

All other relevant information is already on the website at the link
originally provided.

 

Please also note that third party information has been removed from the

However, even this partial response shows that Shropshire Council has not provided all relevant information in its response to the internal review. This is evidenced by:

2. The email from the Director of Public Health Shropshire dated 13 September 2019 at 08:43, clearly states:

·         We do not know what the jpg file relates to as there is no map
or picture attached to the email in question

·         The final attachment is the one titled:
‘r-(on-the-application-of-squire)-v-shropshire-council-judgment-24-may-2019.pdf’
this is a court judgment and all court judgments are a matter of public
record so this is available already by other means.

 

2. The email from the Director of Public Health Shropshire dated 13

introduction/sharing meeting between Shropshire Public Health and PHE who
dialled in.

This is referring to the response from planning and ecology regarding the
queries; Planning are collating responses from across the Council but all
information held at the time of your request has been provided.

 

   2.3. The author of the email asks the multiple recipients of the email
to “provide a response please”. It is implausible there were no responses
to the author of this email given their position as Director within the
authority.

Following the email the director had a brief phone conversation with
Regulatory Services to confirm this was being addressed, the DPH was
assured that this matter was being addressed through planning and ecology
(part of Regulatory Services) from a Council perspective.  Previously the
DPH had confirmed that PHE were involved and leading the response from a
Public Health perspective, as the subject matter experts. 

 

   2.4. The author of the email asks that PHE keep them updated and in the
loop. Again, It is implausible there has not been any further
correspondence in relation to the author’s request.

Planning confirmed that a letter was put together by PHE giving the latest
advice.  Planning and ecology continue to liaise directly with PHE on this
matter for any further updates.

 

   2.5. The author of the email states they will put together a summary
for “Dean and Rob” and requests “a few lines about this”. This further
information has not been provided.

A committee paper is being pulled together for early 2020 which will pick
up this summary and the requirements for a summary.  The delay has been
due to staffing and waiting for a case to be concluded

 

   2.6. The author of the email suggests a conference call. No information
relating to this call has been provided.

There are no notes relating to the conversation as it was an informal call
covered in the points above.

 

In relation to this particular aspect of the request please find attached
an email chain that has been found that is relevant to your request.

 

3. The email from the Natural Environment Team Leader (Ecology) Regulatory
Services — Environmental Protection Team Public Health Shropshire Council,
on 29th May 2019 at 16:05:00, is in response to correspondence from

I can confirm that the email sent dated 29th May was in response to a
telephone request from Natural England (Grady Mclean) to supply a copy of
the court case judgment for general interest as it could have relevance to
other casework for Natural England.

Thank you for releasing a little more information. However, there still appears to be information missing from your responses.

Please see below annotated comments regarding your latest response.

With reference to item 2, the email from the Director of Public Health Shropshire dated 13 September 2019 at 08:43, clearly states:

[SC] There are no notes of this meeting, this was an informal introduction/sharing meeting between Shropshire Public Health and PHE who dialled in.

[GE] The Director of Public Health’s email clearly states that they [Council officers] met with PHE rather than PHE dialling in as now claimed in your response. Therefore, as previously requested, please provide notes/minutes from this meeting and any other relevant meetings. It certainly would be surprising if notes or minutes were not made and retained, especially as the meeting involves a Shropshire Council Director and that the two officers involved were specifically asked by that Director to “keep all in the loop”.

2.2. That Shropshire Council has, “been through this to make a response to the comment”, therefore there must be further recorded information or correspondence that has not been provided.

[SC] This is referring to the response from planning and ecology regarding the queries; Planning are collating responses from across the Council but all information held at the time of your request has been provided.

[GE] Your comment does not tally with the Director of Public Health’s comment, “have through [sic] this to make a response to the comment”. Your Director clearly states that the information has already been gone through in respect to the statement, “Furthermore, we strongly suggest that Shropshire Council seriously consider the findings of the 2019 Squire v Shropshire Council judgment which made clear that Council planners could not rely on the existence of an environmental permit to abrogate their responsibility to carry out an assessment in accordance with the regime for EIA”. Therefore, as previously requested, please provide all information in relation to this item.
 
2.3. The author of the email asks the multiple recipients of the email to “provide a response please”. It is implausible there were no responses to the author of this email given their position as Director within the authority.

[GE] A Director’s request would not be ignored by staff, especially given the gravity of the matter since it relates to a chicken factory that will, if built, affect the lives, health, and well being of thousands of people for generations to come. It is incredulous, therefore implausible, for all communication, both internal and external with ‘subject matter experts’ such as PHE, to be entirely anecdotal without any form of written record. Furthermore, as this conversation took place in September, either someone has a very good memory or (more likely) records regarding this phone conversation were retained. Therefore, as previously requested, please provide all information in relation to this item.

I am meeting them on Monday so if I could have a few lines about this I will flag it to them”. The Director clearly requests a summary for Dean and Rob for a meeting on Monday, not information for a future committee paper in 2020 as you now claim. Therefore, as previously requested, please provide all information in relation to this item.

[SC] There are no notes relating to the conversation as it was an informal call covered in the points above.

[GE] Again, it is unlikely there was no follow up email to the conference call as standard business practice is to follow up such calls with a summary/actions and decisions, particularly as one of the outcomes from the conference call would result in the summary for Dean and Rob.
 
[SC] In relation to this particular aspect of the request please find attached an email chain that has been found that is relevant to your request.

[GE] In the further information you have now provided, the email from Ms Collier states: “Thank you Rachel. I’ve copied to Kieron. For info Matt Clark is currently off. We will have a look at the information you have sent – Kieron can you put a few lines together for Rachel please whilst we look at this in more detail.” Therefore, where is the information from Kieron, and also the further information which will be provided after this has been looked at in more detail? Ms Collier’s email clearly states they will look at the information in more detail. Again, it is implausible that officers would not have provided a further written update as requested by a Director.

In summary, it is now well over 3 months since I originally requested “a copy of all correspondence received or sent by Shropshire Council’s Ecology function with respect to the planning application 17/01033/EIA for an intensive poultry unit at Footbridge Farm, Bridgnorth”.

The information I requested relates specifically to the ecological aspect of the proposal to develop an industrial chicken factory at Tasley on the edge of the historic town of Bridgnorth. If built, objectors claim it will blight the lives and health of thousands of people, harm the local economy, and pollute the environment over the 60+ years it will operate.

Notwithstanding the gravity of this matter, you have repeatedly claimed that the information I requested cannot not be provided because all communications, presumably in context of my request, are entirely anecdotal without any form of written record. However, every time I have presented examples contradicting this implausible claim, a little more information in the form of written correspondence has been provided.

Despite this protracted process of incremental delivery of sparse and occasionally irrelevant information (see item 2.5), the information I originally requested has still not been provided. As a result, I now update my original request to include information up to and including the date of this response.

I look forward to a timely response, and remind the Council that, despite several reminders, a full and proper response to this request is well overdue.

Dear Shropshire Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Shropshire Council's handling of my FOI request 'Planning application 17/0133/EIA' due to the following reasons:

- I have repeatedly had to chase Shropshire Council over this request which is long overdue.
- Initially Shropshire Council stated no information was held, then after prompting, the Council provided 3 documents, and after further prompting provided 2 more documents.
- Both times it was obvious from reading the content of the documents that the Council had not provided all of the information relevant to this request.
- My penultimate email contains detailed analysis explaining why the Council has still failed to provide all information relevant to this request.
- After a further prompt, the Council stated that no more information is held. However, the content of the documents already provided again renders this statement implausible.

It is apparent from the history of this FOI request that the Council has been reluctant to provide the requested information.
