Planning Applicaiton 170021 - AFC Stadium At Kinsford

Dear Aberdeen City Council,

I would like information in specific regard to the following planning condition on application 170021. Please provide any and all correspondence, records, notes or information in regard to the consultation referred to below with Police Scotland and Transport Scotland. I understand that this information should have been supplied to the council in order for the condition to be compliant.

Junction Details
(26) That no development relating to Phase 1 (Training Facilities) or Phase 2
(Stadium) shall be commenced unless details of the road access junctions with the
A944 to serve that phase of development (as established via condition 1: Phasing),
including inter alia: junction layout, traffic signals and timings, and interface with
existing cycle/footways have been submitted to, and approved by, the Planning
Authority, following consultation with Transport Scotland and Police Scotland.
Thereafter, no buildings within that phase shall be brought into use unless the
junctions have been constructed and made available for use in accordance with the
agreed plans - To minimise interference with the safety and free flow of traffic on the
trunk road network.

Council (ACC) has completed the necessary search for the information
requested.

 

I would like information in specific regard to the following planning
condition on application 170021.  Please provide any and all
correspondence, records, notes or information in regard to the
consultation referred to below with Police Scotland and Transport
Scotland.   I understand that this information should have been supplied
to the council in order for the condition to be compliant.

This information is not held by ACC.  There is no statutory requirement
with Transport Scotland or Police Scotland at this stage.  Notwithstanding
the wording of condition 26, Transport Scotland and Police Scotland were
not consulted on the access junction serving Phase 1 of the development,
on the basis that Phase 1 does not include the stadium itself, or
otherwise generate any significant demands on the trunk road network or
affecting Police Scotland interests.  ACC in its role as Planning
Authority is responsible for both consultation in relation to planning
applications and the enforcement of any potential breach of planning
control.  It has exercised is discretion in opting not to consult on the
Phase 1 submissions, and has discretion also in relation to enforcement
matters.

 

Consultation will be undertaken with those bodies in relation to Phase 2
junction details, which have implications for the interests of Transport
Scotland and Police Scotland. 

 

ACC is unable to provide you with information on any and all
correspondence, records, notes or information in regard to the
consultation referred to above with Police Scotland and Transport Scotland
as it is not held by the Council.  In order to comply with its obligations
under the terms of Regulation 10(4)(a) - Information Not Held - of the
EIRs, ACC hereby gives notice that this information is not held by it. 
ACC is required by Regulation 10(1)(b) of the EIRs to inform you as to why
in all the circumstances of the case, the public interest in maintaining
this exception outweighs the public interest in disclosing this
information to you.  ACC is satisfied that it does not hold this
information and considers that, as there is no information held, the
public interest lies with the exception.
