PFI Revenue Funding - Yorkshire Housing

Dear Leeds City Council,

I write regarding Yorkshire Housing Limited, and the structure of the Group also has a third share in Yorkshire Transformations Holdings Limited which operates a PFI scheme for Leeds Council. This share has been consolidated in the Group under the appropriate accounting policies.

Under the provisions of FOIA please advise the following in electronic format:

Please advise if Leeds City Council has awarded funding to Yorkshire Housing for the purpose of PFI Revenue generated capital investment in new build housing stock?

If the answer is yes,

Please advise the total amount of funding awarded to Yorkshire Housing for each financial year from 2013/14 for PFI Revenue generated capital investment in new build housing stock?

Please also advise if the Housing Association being the procurement authority, have to report directly to the Leeds City Council the detail of any/all spends of the funding awarded for various reasons including but not limited to audit purposes, as Leeds City Council has a role in ensuring that all funding awards keep within UK Government HM Treasury budgeting requirements.

Please advise if any funding allocation to Yorkshire Housing, made by the Leeds City Council to Yorkshire Housing for the purpose of PFI Revenue generated capital investment in new build housing stock is considered/noted for accounting practice as 'revenue' funding or 'capital funding'?

Please advise if the Leeds City Council will continue to fund any part of the annual unitary charges that Yorkshire Housing are legally bound to pay per the terms of any PFI contract, and if so what Yorkshire Housing budget stream would they be allocated to, and which budget stream would they be allocated from by the Leeds City Council?

You did not answer the following question :

Having reviewed your request, we now provide the following response to the
question you have highlighted:

As a housing association, Yorkshire Housing Limited (YHL) will be subject
to the Public Contracts Regulations 2015 as a body governed by public
law.  However this does not require YHL to report procurement activity to
Leeds City Council (LCC)

 

Contractually, under the Swarcliffe PFI project there is no requirement
for YHL to directly report to LCC on their spend on the project. 

 

Under PFI project agreement between LCC and Yorkshire Transformations
Limited (YTL), YTL is obliged to maintain records in respect of personnel
and activities relating to the project agreement, including information on
sub-contracts, purchase details, costs of Works and Services and books of
account. YTL must ensure that its sub-contractors (including YHL) also
maintains such records in respect of their own activities.  YTL must make
all such information is to be made available to LCC, its auditors and the
Audit Commission on request.  Therefore there is an indirect obligation on
YHL to report to LCC on its activities and spend under the Swarcliffe PFI
Project.

or regular audits.

We have not undertaken any form of audit on YH during the contract.
